Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Montana-Dakota Utilities Co. (MDU or the Company) for authority to change the Conditions of Service Rate 100 schedule to include the MDU’s overtime rate for after-hours service, as more fully described below.
1. MDU is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.
2. On February 28, 2024, MDU filed an Application requesting to change Rate 100, tariff sheet 2, revised Sheet No. 111 and 112, to reflect the overtime rate for after-hours service per Commission staff request. The Company states Commission Staff requested clarified tariffs for standard overtime rates and after-hours overtime rates for service performed outside of normal business hours to remedy the gap for compliance with Wyoming Statute § 37-3-102.
3. The current minimum overtime rate is $140.00 for one hour of work or less outside the Company’s normal business hours of 8;00 a.m. to 5:00 p.m., Monday through Friday, MST. Services beyond that first hour will incur a $45.00 fee for each additional 15 minutes of after-hours work.
