Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, May 4, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Chairman Livingston led the audience in the Pledge of Allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Commissioner Tilden made a motion to approve the following consent agenda items: minutes from April 20; bi-weekly payroll in the amount of $388,224.85; vouchers; approve to Release Retainage for Reiman Construction – Bridge DDO Replacement on Wood River; approve Newspaper Ad for Park County Library Board Positions (2) and Park County Museum Board Positions (2), Commissioner Thiel seconded, Commissioner Overfield asked to remove the advertising for the museum board as both members were recently appointed and would like to continue, motion carried.

Mr. Klessens thanked the board for the opportunity to present their request in the amount of $25,000.00 and gave an update on Forward Cody’s activities.
Meeteetse Visitor Center Director, Kristen Yoder – RE: Park County FY2022 Budget Special Funding Request
Ms. Yoder thanked the board for the opportunity to present their request in the amount of $6,000.00 and update the board on some new events they have added to the community.
Youth Clubs of Park County Executive Director, Tina Bernard – RE: Park County FY2022 Budget Special Funding Request
Ms. Bernard and Ms. Wutzke thanked the board for the opportunity to present their request in the amount of $25,000.00 and for helping with the landfill fee reduction during the building project.
Crisis Intervention Services Director, Lisa Peterman – RE: Park County FY2022 Budget Special Funding Request
Ms. Peterman thanked the board for the opportunity to present their request in the amount of $10,000.00 which is used for grant match through the Victim of Crime Act program.
Meeteetse Senior Citizens Center, Norma Riley – RE: Park County FY2022 Budget Special Funding Request
Ms. Riley thanked the board for the opportunity to present their request in the amount of $10,000.00 which is used for grant match.
Park County Clerk, Colleen Renner – RE: Approve and Award Park County 2021 Scholarships
After discussion on the number of scholarships given out Commissioner Thiel made a motion to award the scholarships to Hadley Abarr, Meeteetse, Carter Schutzman, Cody and Madelyn Horton, Powell, Commissioner Tilden seconded, and motion carried. Commissioner Overfield made a motion to award Mason Merager, Cody for the renewal scholarship, Commissioner Tilden seconded, and motion carried.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Umphlett Minor Subdivision -25 Partial Vacation and Amended Plat (Lot 3)
Mr. Dillivan presented the amended plat application to vacate lot 3 reconfigure and create Lot 103. The land is in a GR-5 zoning district. The property is located 3 miles east of Cody on the northside of the Greybull Hwy. No public comments were received, nor is a hearing required. Surrounding land is agriculture and residential. Commissioner Tilden made a motion to approve Commissioner Thiel seconded, and motion carried. RESOLUTION 2021-21
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Harshman Simple Subdivision-268 Final Plat Review
Mr. Dillivan present the final plat application to create two lots consisting of one 21.79-acre and one 30.63-acre lots. The location is 5.5 miles southeast of Powell near County Road 5 and Lane 11 and is zoned GR-P. Neighboring land is ag and residential and south of Shoshone River. No public comments were received, nor is a hearing required. After explanation regarding the septic system, Commissioner Overfield made a motion for approval of the final plat, Commissioner Thiel seconded, and motion carried. RESOLTUION 2021-22
Park County Animal Shelter Executive Director, Megan McLean – RE: Park County FY2022 Budget Special Funding Request
Ms. McClean thanked the board for the opportunity to present their request in the amount of $10,500.00 and for helping with dollars to build the new shelter.
Park County First Deputy Clerk, Hans Odde – RE: Public Hearing: Approve to Transfer Hidden Creek Liquor License to UVU 1929 LLC
Chairman Livingston opened the public hearing. Mr. Odde presented the transfer application. Discussion regarding ownership, closing, state approval and the lease with Shoshone Forest Service, and no public comments were submitted. Commissioner Thiel made a motion to close the public hearing and Commissioner Overfield seconded, and motion carried.
Commissioner Thiel made a motion to approve the transfer of the liquor license contingent on the closing and the forest service lease being completed, Commissioner Mangold seconded, and motion carried
Mannahouse Food Pantry President, Charlie Jones – RE: Park County FY2022 Budget Special Funding Request
Mr. Jones thanked the board for the opportunity to present their request in the amount of $12,000.00. Mr. Jones also gave an update of the building lease and partnering with organizations to receive food.
Park County Sheriff, Scott Steward – RE:
• Open Sealed Bids for Search and Rescue Truck – Two bids were received, one from Fremont Motors, Cody for a 2022 Ford F350 in the amount of $52,273; a 2022 Ram 3500 for $45,334; the second bid was from Denny Menholt for a 2022 Chevy Silverado Crew Cab in the amount of $44,929. Sheriff Steward will review the bids for conformity and return with a recommendation.
• Approval to Replace Park County Sheriff Personnel – Sheriff Steward stated they are down three positions. He is requesting permission to stay at the staffing level that has been approved and to not have to return each time a position becomes vacant. After discussion Commissioner Overfield made a motion to allow replacement but if requesting a higher pay rate Sheriff Steward will return, Commissioner Tilden seconded, and motion carried
Park County Museum Board Chair, Dakota Russell – RE: Approve Homesteader Museum Staffing Request
Mr. Russell and Ms. Wright are requesting to fill two positions, one is full-time, and one is part-time. Commissioner Overfield made a motion to allow the request, Commissioner Tilden seconded, and motion carried.
Park County Clerk, Colleen Renner – RE: Approval to Replace Park County Clerk Personnel
Commissioner Thiel made a motion to allow the Clerk to fill a full-time position instead of part-time, Commissioner Tilden seconded, motion carried.
Clerk Renner also requested at this time an increase for all employees in that department and remain within her budget. After discussion Commissioner Tilden suggested these requests all be made along with all departments during budget talks.
Park County Commissioners – RE: Public Hearing: Notice of Appeal on Park County Engineer’s, Brian Edwards, Decision on Administrative Relief on the
Westlinc Minor Subdivision
Chairman Livingston opened the public hearing.
Mr. Scott Lewis, Granite Engineering presented why the 60 ft. easement that is required would be hard to achieve in this subdivision. Mr. Lewis has worked with the adjoining landowners and has only been able to achieve 40 feet for the easement, therefore the request for administrative relief.
Chairman Livingston called for comments. After hearing from Brian Edwards, County Engineer and Joy Hill, Planning Director and the Boards questions being answered regarding the easement, future subdivisions, burying the ditch, and proximity to the City of Powell, there being no further comments, Commissioner Overfield made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Thiel made a motion to grant the administrative relief for the 40-foot easement vs 60-foot, with the stipulation that the road is not dedicated to the public on the plat, Commissioner Mangold seconded, Commissioner Tilden opposed, and motion carried.
Park County Planning & Zoning II, Kim Dillivan – RE: Big Sky Sunrise Simple Subdivision- 271 Final Plat Review
Mr. Dillivan presented the final plat application for Stephen Deroche on a two-lot simple subdivision creating an 8.15-acre lot and a 11.92-acre lot for residential use. The location is 7.5 miles southwest of Cody with an address of 24 Big Sky Road, GR-5 zoning with ag and residential use, no public comments were received.
Commissioner Tilden made a motion to approve, Commissioner Thiel seconded, and motion carried. RESOLUTION 2021-23
Park County Commissioners – RE: Discussion on Park County Second Amendment Preservation Resolution
Chairman Livingston presented the resolution stating the Park County Board of Commissioners and the Sheriff strongly support the Second Amendment of the Constitution of the United States of America and Article 1, Section 24 of the Constitution of the State of Wyoming.
Commissioner Overfield made a motion to adopt the resolution, Commissioner Tilden seconded, and motion carried. RESOLUTION 2021-24
Park County Clerk, Colleen Renner – RE:
• Open Bids for Park County Auditor – The deadline for bids was April 30. One bid was received from Carver, Florek, James, CPA’s out of Rock Springs and Utah. Proposed fee maximums are $48,000; 2022-$49,500 and 2023-$50,000. The Clerk and First Deputy will review and return with a recommendation on May 18.
• Discussion on the Healthy is Contract –Commissioner Tilden made a motion to approve the contract, Commissioner Overfield seconded, and motion carried
Sheriff Steward returned with his recommendation for the lowest bid received which was Denny Menholt. Commissioner Overfield made a motion to approve the bid for the Chevy Silverado, Commissioner Tilden seconded, and motion carried.
Park County Commissioners – RE: Interviews for the Park County Planning & Zoning Commission
– Kellie Ellwood – was a no show. Commissioner Overfield made a motion to re-advertise but do not specify an area, we will reschedule the interview with Mr. Ellwood if he had a legitimate excuse for missing his interview, Commissioner Tilden seconded, and motion carried
