Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, April 21, 2020. Present were Vice Chairman, Lee Livingston, Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner.
Commissioner Livingston led the audience in the Pledge of Allegiance.

Commissioner Livingston made a motion to approve the following consent agenda items: minutes from April 7; bi-weekly payroll in the amount of $583,226.25; vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; second quarter FYY 2019-20 TANF; and approval to retain the current auditors, Carver Florek & James, CPA’s for one additional year; Commissioner Fulkerson seconded and the motion carried.

Library Director, France Clymer - RE: Approval to Replace Powell Librarian
Ms. Clymer requested to fill a position that was vacated due to the death of Margaret Sullivan. The final decision on filling the position is up to the Library Board. The board thanked her for the update and wished her well in her retirement.
The Commissioners heard testimony from the Special Funding Entities who receive funding from Park County.

Planning & Zoning Director, Joy Hill – RE: Public Hearing: Zoning of Un-zoned Parcel – Zoning Map Amendment, Park County Land/Cody Shooting Complex
Chairman Tilden opened the public hearing.
Ms. Hill reported this land is currently owned by the United States and has never been zoned. Agency referrals were notified, and no public comments were received. The land is 297.5 acres and was granted November 10, 2010 recording number 2010-7578. The recommendation will be to assign a GR-35 zoning designation to this parcel of land.
Chairman Tilden called for public comments, there being no comments Commissioner Livingston made a motion to close the public hearing, Commissioner Fulkerson seconded, and motion carried.
Commissioner Fulkerson made a motion to amend the county zoning designation to the Cody Shooting Complex to GR-35, Commissioner Overfield seconded, and motion carried. Resolution 2020-14
Treasurer, Barb Poley – RE: Discussion on Pushing Back Park County May 2020 Taxes Back
Ms. Poley pulled the taxation report and as of April 21, 67.5% of taxes have been paid at this time compared to 67.3% last year. Ms. Poley sees no reason to change when taxes are due, many are paid through escrow. Ms. Poley will be working with the elderly for the Seniors Wyoming property tax program, applications are due to the state by June 1 and she anticipates helping approximately 125 residents.
Mr. Meyer, Assessor spoke briefly regarding assessed value, fielding calls from taxpayers, sending the assessment schedules and making appointments for appeals at the end of August.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: 3 Sisters Minor Subdivision Sketch Plan Review -34
Chairman Tilden opened the public hearing.
Mr. Dillivan reported on the sketch plan to create a four-lot minor subdivision with differing lot sizes for Russ and Diane Whitlock. The proposed subdivision is located 9.5 miles southwest of Cody on Jody Lane. Agency referrals were received, and comments made, there were no public comments.
Staff stated there are requests from applicable utilities and special districts that will be addressed prior to final plat. There was also discussion about the Lakeview Irrigation providing comments prior to the final plat. Mr. Whitlock stated the biggest hurdle is with irrigation, he is working with Lakeview to meter the property.
There being no further discussion Commissioner Livingston made a motion to close the public hearing, Commissioner Overfield seconded, and motion carried.
Commissioner Fulkerson made a motion to approve the sketch plan as presented. Commissioner Livingston seconded, and motion carried. Resolution 2020-15
Park County Planning & Zoning Planner II, Joy Hill – RE: Public Hearing - Game & Fish Flood Plain Permit - 320
Chairman Tilden opened the public hearing.
Ms. Hill requested with Game & Fish approval to continue this public hearing. Commissioner Livingston made a motion to continue the public hearing, Commissioner Overfield seconded and motion carried. The public hearing will continue May 19, 2020 at 9:45 a.m., motion carried
Park County Planning & Zoning Director, Kim Dillivan – RE: Partial Vacation & Amended Plat of Heart View Minor Subdivision - 33
Mr. Dillivan presented a partial vacation and amended plat. Applicants are Pete and Tanna DiPilla vacating a 20-foot irrigation easement located on the north side of Lot 2. The DiPilla’s thought this easement was necessary to serve Lot 5 and after contacting Shoshone Irrigation found out this easement is not necessary.
Commissioner Overfield made a motion to approve as presented, Commissioner Livingston seconded, and motion carried.
Park County Commissioners – RE: Discussion Park County Lease Agreement with Point Café and Monthly Payments
After discussion regarding the closing of the Library and no public access to the restaurant. Commissioner Thiel made a motion to wave the $250.00 fee until the Library re-opens and then extend the lease agreement to fill the 6-months, which allows her four months, unless at the June lease date the client would like to withdraw from the lease, Commissioner Livingston seconded and motion carried.
Park County Commissioners – RE: Park County Scholarship Selections
Commissioner Tilden recused himself and Commissioner Livingston stepped in as Vice Chair.
After discussion of the matrix Commissioner Fulkerson made a motion to award scholarships to Mason Merager, Colin Queen, Sloan Asay and Madison Icenogle as the alternate. Julia Cook will receive the renewal scholarship. Commissioner Overfield seconded, and motion carried.
Park County Engineer, Brian Edwards & Project Manager, Ben McDonald – RE: Discussion on Nelson Log Restoration – Easement Across Park County Lands
Carlos Rivera representing Nelson Log Restoration joined the meeting telephonically. Attorney Thompson was unable to attend. Mr. McDonald briefed the Board on an easement that the county deeded to Lofland’s in 1993 which is located by the sewage lagoons. The original purpose of this easement is to allow ingress and egress to the owners of Lofland Property. Park County is now granting and conveying a permanent access easement to the owners. Commissioner Thiel made a motion to exchange upon the approval from Mr. Skoric, County Attorney, Commissioner Fulkerson seconded, and motion carried.
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ii), Commissioner Theil seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. Commissioner Thiel made a motion to allow the Clerk to move an employee from a Clerk II to a Clerk III and not hire a temporary employee, Commissioner Livingston seconded, and motion carried.
