July 1, 2019
The governing body of the City of Powell met in regular session at 6:00 p.m. on July 1, 2019 in the Council Chambers of City Hall. Mayor Wetzel opened the meeting and led those in attendance in reciting the Pledge of Allegiance. Mayor Wetzel called the meeting to order and the following were present: Mayor John Wetzel, Council Members Jim Hillberry, Floyd Young, Tim Sapp, Scott Mangold, Lesli Spencer and Steven Lensegrav. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Sandee Kitchen, Deputy City Attorney Scott Kath and Electric Supt. Steve Franck.
Approval of Agenda: Request to add under Administrative, Declaration of Emergency. Councilwoman Spencer moved to approve the agenda as amended, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Approval of June 17, 2019 minutes: Councilman Young moved to approve all minutes as presented, seconded by Councilman Hillberry, unanimous approval, MOTION CARRIED.
Bills and Claims: Councilman Hillberry abstained #41 and Councilman Lensegrav #51. Councilman Mangold made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Resolution No. 5, 2019: A Resolution Providing for Exceptions to the Open Container Laws for the City of Powell for a Special Occasion Open to the Public and Observed by the Community at Large. Gestalt Studios, Gypsy Market July 13th, July 27th and Aug. 19th. Erin Johnson, owner of Gestalt, explained the event. Councilwoman Spencer moved to approve, seconded by Councilman Hillberry, unanimous approval, MOTION CARRIED.
Malt Beverage permits for Gestalt Studios, Gypsy Market July 13th, July 27th and Aug. 10th at 440 W Park St. Councilman Mangold moved to approve, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Resolution No. 5, 2019: A Resolution Providing for Exceptions to the Open Container Laws for the City of Powell for a Special Occasion Open to the Public and Observed by the Community at Large. Plaza Diane July 18th for Italian Dinner on the Plaza. Councilman Young moved to approve, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Resolution No. 6, 2019: A Resolution Providing for Exceptions to the Open Container Laws for the City of Powell for a Special Occasion Open to the Public and Observed by the Community at Large. Plaza Diane Aug. 17th for Renaissance Fair. Councilman Lensegrav moved to approve, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Request for waiver of fees of $35 for park reservation Sept. 13th at Washington Park for Farm to Table Fundraiser for Homesteader Museum. Councilman Hillberry moved to approve, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Burning concerns addressed by Linda Johnson and Kay Anderson. Would like an update to the discussion from May 20, 2019 Council meeting on burning in town. Administrator Thorington read the current code section 8.16.010. Ms. Johnson had handouts of Rock Springs and Cheyenne for the council and expressed she would like it to be the moral responsibility of neighbors to not have obnoxious smoke. Concerns on fire pits and police have no recourse. Mayor Wetzel said they would look at what she has brought, Councilman Mangold asked if the police had been called and Ms. Johnson said yes on several occasions. Ms. Johnson stated the smoke is hard on her health. Councilman Hillberry stated it might be impossible to regulate smoke within the city. Committee Updates: Updates given by Councilwoman Spencer for PEP.
Ordinance No. 9, 2019: Read by title Attorney Kitchen: An Ordinance Amending Paragraph G of Section 10.32.020 of the Powell City Code by Allowing Parallel Parking of Recreational Vehicles in Diagonal Parking Spots Abutting Residential Dwelling Units Owned or Rented by the Owner of the Recreational Vehicle Under Certain Circumstances. Council discussed the ordinance and reasoning for the change. Councilman Hillberry moved to approve on first reading, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Annual Policy and Procedure Updates: sections 4.1, 4.2, 4.6, 5.14, 6.3 and 7.13 presented to Council for updates by Administrator Thorington. Councilman Young moved to approve, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Animal Shelter Agreement presented by Administrator Thorington and no changes, just update of terms. Councilman Young moved to approve and authorize signatures, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Declaration of Emergency request: Electric Supt. Franck explained the issues arising June 29, 2019 at the City’s substation and how they are planning on getting the City’s electric system back to normal conditions. Declaration is for services used and emergency items purchased to stabilize the electrical system. Mayor Wetzel addressed the substation is currently operating in a restricted crippled state and need to get things up and running to what it was before the incident. Councilman Lensegrav moved to approve the declaration and authorize all necessary signatures and expenditures as necessary, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Councilman Mangold asked if they have looked at a redundant substation in the future and Electric Supt. Franck stated they have had discussions and will be looking at upgrading the current substation.
General Announcements: Administrator Thorington thanked the police, fire and electric crews as well as W.A.P.A, Garland Light & Power and the City of Cody for the help with the electric substation. Mayor Wetzel thanked everyone and praised that no one was hurt and everyone came together to help.
There being no further business to be considered at this meeting, Councilman Hillberry moved to adjourn, seconded by Councilwoman Spencer unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:46 p.m.
