A Cody man arrested three times this year faces revocation of his probation for a marijuana possession charge he faced in 2021.

A petition was filed in state district court in Cody on Thursday seeking to revoke the probation of Joseph Wooden, who was arrested July 1 on charges of being a minor in possession of alcohol, being under the influence of a controlled substance and speeding.

Wooden pleaded not guilty to the charges on July 5.

Wooden pleaded guilty in 2021 to a felony count of possessing marijuana with intent to distribute and one misdemeanor charge of being a minor in possession of alcohol.

He pleaded guilty to both charges in September 2021 and Judge Bill Simpson ruled that if Wooden completed 18 months of unsupervised probation, the marijuana charge would be dismissed. Simpson ordered Wooden not to consume alcohol or break any laws during his probation.

Wooden was charged with possessing a controlled substance in a plant form in May and in June, he was charged with being a minor with a measurable blood-alcohol content.

In his latest arrest, according to an affidavit by Cody Police Officer Tanner Wichern, Wooden’s vehicle was pulled over July 1 after it was detected traveling 34 mph in a 25 mph speed zone.

After pulling Wooden’s vehicle over, dispatch informed Wichern that as a condition of his probation, Wooden was subject to being searched and being tested for drugs and alcohol.

Wooden and his passenger were asked to exit the vehicle while Wichern and Cody Police Officer Brandon Tillery searched it. 

During the search a known associate of Wooden’s approached the vehicle and admitted to being under the influence of alcohol, as well as under the age of 21.

The search of the vehicle revealed “one sealed Twisted Tea bottle, one open and partially empty Twisted Tea bottle, and one open and partially empty flavored vodka bottle.” 

Breath tests on Wooden came back showing a blood-alcohol content of 0.0%, while his passenger tested at 0.02%. The passenger was cited for consuming alcohol while a minor.

Wooden was taken to the Park County Detention Center where he tested positive for THC use via urinalysis. 

A petition to revoke Wooden’s felony probation was filed on Thursday. The petition cites affidavits written by Powell Police Officers Kevin Bennett and Trevor Carpenter.

Bennett’s affidavit concerns Wooden’s arrest in May for possessing a controlled substance in plant form.

Carpenter’s affidavit alleges Wooden was involved in a “physical fight with a juvenile” on Avenue C then proceeded to interfere with the police investigation into the incident by lying about his whereabouts. The July 1, 2022 arrest by Wichern was also cited.

No decision on the petition to revoke Wooden’s probation had been made by press time.
