Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, November 16, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Ann Trosper led the audience in the Pledge of Allegiance.

Commissioner Tilden made a motion to approve the following consent agenda items: Minutes 11/2/21; payroll in the amount of $91,655.78 for Elected and $426,734.13 employees; vouchers; sign monthly Earnings & Collections Statements for Clerk, Clerk of District Court and Sheriff; Park County Lease Agreements with Wyoming Coalition Against Domestic Violence and Sexual Assault and Wyoming Legal Aid; Memorandum of Agreement with Federal Highway Administration and United States Forest Service for Federal Lands Access Program (FLAP) funding for Phase 2 – County Road 6WX (Southfork Road). Commissioner Overfield seconded, and motion carried.

Commissioner RE: Thank You Presentation for Funding for their Workshop and Update on Results, Ann Trosper
Ms. Trosper gave a brief update on how well the small acreage workshop went and offered thanks to the County for the support. All three major irrigation district assessments were used for mailing the information out to landowners. Chairman Livingston stated this was a very timely workshop for those who purchased 5 acres and have no clue about irrigation
First Deputy Clerk, Hans Odde RE: Public Hearing: Disposal of Grant Funded Infrastructure from Park County to Yellowstone Recreations, LLC.
Chairman Livingston opened the public hearing and Mr. Odde and James Klessens, Forward Cody discussed with the board the Wyoming Business Council’s Business Ready Community grant that helped purchase infrastructure for Sleeping Giant Ski Area in 2010 which was managed at that time by Yellowstone Recreation Foundation.
After discussion regarding liquidation of the equipment and the requirement to follow the Business Council’s process on disposal of the described equipment, Chairman Livingston called for public comments, Jay Nielson, Yellowstone Rec Foundation stated there was a sale with assets when Nicholas Piazza purchased Sleeping Giant.
There being no further comments, Commissioner Tilden made a motion to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Tilden moved to transfer the snow making equipment, Sheep Eater Lift and Magic Carpet lift to Yellowstone Rec foundation, Commissioner Overfield seconded, motion carried.
First Deputy Clerk, Hans Odde RE: LGLP BoD Ballot
Mr. Odde stated the ballot was forwarded to the board from the Clerk as LGLP is the Counties liability carrier.
Commissioner Overfield made a motion to vote for Lindsey Woodward for the Special District Representative, Commissioner Thiel seconded, and motion carried.
Commissioner Thiel made a motion to vote for Linda Smith and Kelly Krakow in the Municipal Elected Official representative race, Commissioner Overfield seconded, and motion carried.
The ballot was signed by the Chairman and emailed to LGLP.
Planning & Zoning Planner II, Kim Dillivan RE: Public Hearing: Willwood Dam Minor Subdivision - Sketch Plan Review
Mr. Dillivan stated that Daniel Martin submitted a minor subdivision on August 30, 2021 for a three-lot subdivision consisting of one – 5.06 acre and two – 5.07 acre lots located in GR-P zoning. Neighboring land is residential and residential vacant. Agency referrals were met, no public comments have been received, irrigation, water wells and conditions are recommended by staff for the final plat.
Chairman Livingston called for public comments, there being none, Commissioner Tilden made a motion to close the public hearing, Commissioner Overfield seconded, and motion carried.
After discussion on water rights Commissioner Tilden made a motion to approve as presented, Commissioner Thiel seconded, and motion carried. RESOLUTION 2021-76
Planning & Zoning Planner II, Kim Dillivan RE: Retirement Ridge SS-279 – Final Plat Review
Mr. Dillivan presented the final plat for Ken Trautman. The subdivision consists of one 18.22-acre lot for residential use and one remaining parcel of 35.90 acres. The lots are in GR-P, neighboring land use is primarily agriculture, agency referrals have been met, and no public comments received. All recommended conditions have been met and the revised final plat was received November 10.
Commissioner Theil moved to approve as presented, Commissioner Tilden seconded, and motion carried. RESOLUTION 2021-77
Cody Shooting Complex, Otis Smith RE: Fencing Issue
Commissioner Overfield received a call from BLM regarding a fence being placed in along the new area of the shooting range. The bike trails that run along Dry Creek were fenced to not allow foot traffic along what looks like a 4-wheel drive path. Clarification is needed to address this issue with BLM and Cody Shooting Complex as to where the fence has been placed. 
Mr. Smith would also like to discuss the possibility of the county helping with the new land that was obtained by allowing the county to grade around the parameters for a skeet shoot range. After some discussion regarding the membership paid to the facility, the county owning the property, and the hours it will take to complete the project, Commissioner Tilden made a motion to approve volunteers from road and bridge to help, with guidance from Mr. Edwards and staff, Commissioner Thiel seconded for discussion and would ask Commissioner Tilden for a friendly amendment to use this opportunity for training exercises with county employees needing training on blades and dozers, Commissioner Tilden accepted the amendment to use county employees for the work, motion carried.
Park County Commissioners RE: Discussion 30 X 30 Land Preservation Goal – Representative Winters
Representative Winters gave the background on what this movement could mean for Wyoming and our public lands. Chairman Livingston questioned what the biggest threat to Wyoming is and Representative Winters stated the wilderness areas, national monuments, rivers and conservation easements will all be under attack. After further questions and comments the Board would like to address this by working on a resolution for opposition of the 30 x 30 land preservation, put forth by President Biden, Dept. of Interior and Agriculture.
Commissioner Thiel moved to draft a resolution to oppose the 30 x 30 plan, Commissioner Tilden seconded and recommended sending the resolution to the President and all the way down the chain, motion carried.
Park County Commissioners RE: USFS Travel Management Plan
Commissioner Tilden thanked Ms. Norberg for the marvelous job she did putting the five board members thoughts together. Commissioner Overfield suggested changing the last “understand” to comprehend. Commissioner Tilden moved to approve, Commissioner Thiel seconded and stated the snowmobile association is who was interested in Alternative #4, motion carried. This document will be emailed, and hard copy sent in mail.
Cody Pardners, Kathy Liscum Re: Continued discussion about proposal to Use Restaurant Space at the Library
Ms. Liscum reported that the liability and renter’s insurance will be affordable to the organization and is ready to negotiate a lease agreement.
Ms. Horner, Library Director is very supportive of this non-profit organization that works with adults in the community and they in turn get to serve the community they live in providing work for the disabled. Ms. Liscum questioned what is meant by signage, ads to promote, hours of use being flexible, equipment maintenance and cleaning, etc. Chairman Livingston asked that Ms. Liscum review the current lease and come back with changes/corrections for a final approval.
Commissioner Tilden was excused for the rest of the day.
Planning & Zoning, Joy Hill Planning Director RE: Consideration of a Land Use GIS Support Proposal from Legacy Works
Hill gave a brief history of how Arthur Middleton, Legacy Works approached planning and zoning regarding GIS for ag land and wildlife, subdivision layers, all of which are needing work. Legacy Works would like to team with the county to make the data more accurate. Doug Wachob stated how they would work to bring all the public and base data together, fixing layers, and the ag overlay use plan. The timeline for completion would be around the third week of January. Chairman Livingston questioned the procurement, Commissioner Overfield felt this is an unusual request but a shared cost that won’t be known until completion. Commissioner Overfield made a motion to approve as presented, Commissioner Thiel seconded, motion carried.
Planning & Zoning, Kim Dillivan RE: Final Plat Review Cornerstone MS-59
Mr. Dillivan presented the final plat for Kevin & Alison French. The draft for the subdivision improvements agreement was received and approved by the County Attorney’s office. This is a five-lot subdivision consisting of one 6.24-acre lot, one 5.81-acre lot, one 5.84-acre lot, one 7.96-acre lot and one 5.74-acre lot, all for residential use in GR-P zoning. No public comments received, and all conditions have been met.
Commissioner Overfield questioned the potable water, Nick Hummel Engineering Associates stated once lots are sold then the wells will be drilled.
Commissioner Overfield made a motion to approve the Subdivision Improvements Agreement as presented, Commissioner Mangold seconded, and motion carried. Commissioner Thiel moved to approve the minor subdivision final plat review, Commissioner Overfield seconded, and motion carried. RESOLUTION 2021-78
Treasurer, Barb Poley RE: Request for new position
Ms. Poley stated with the legislative change and how taxes come to the county and disbursements are made, Ms. Poley feels that it would be best to have an additional position to handle this workload, therefore she is requesting to create a new position. The Commissioners discussed the new rules legislators make and how it effects counties and their budgets.
Commissioner Overfield made a motion to allow the new position as presented and review the Treasurers budget, Commissioner Thiel seconded, and motion carried.
Commissioners RE: Part-Time Circuit Court Magistrate Jim Davis –
Chairman Livingston stated due to the time lapse in Judge Waters retiring and Mr. Darrah becoming the Circuit Court Judge the court will be without a Judge for a short period, therefore it is necessary to appoint Jim Davis as Part-Time Circuit Court Magistrate. Commissioner Mangold moved to approve the appointment, Commissioner Overfield seconded, and motion carried.
Mr. Conners – Translator at Clark
Mr. Conners wanted to update the board on the radio site out at Clark which did not blow up but was destroyed by the winds. Mr. Conners spoke with both Buildings & Grounds and Public Works to get some help with a dump truck to remove the debris that is all over the land where the building was located. WARM has been notified and Chairman Livingston suggested working with the departments to help where they can in cleaning up out at Clark. Mr. Conners also reported that entities have been contacted regarding the translator being gone as it repeats emergency services radio transmissions.
