Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, July 18, 2023. Present were Vice Chairman, Lloyd Thiel, Commissioners Scott Mangold, Scott Steward and Clerk Colleen Renner, Commissioner Lee Livingston was absent.
Steve Pomajzl led the audience in the pledge of allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Chairwoman Overfield stated vouchers will be pulled from the consent agenda and will be put on the regular agenda for approval at 9:40 a.m.
Commissioner Thiel made a motion to approve the following consent agenda items as amended. Minutes from July 5, 2023, payroll in the amount of $460,859.04; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; approve and allow Chair to sign TANF FFY2023 Q3 Report; Annual Compensation Agreement for UW Extension Educator and approve and sign Resolution Concerning Special Prosecution - RESOLUTION 2023-37. Commissioner Mangold seconded; motion carried.
Commissioners – RE: Public Hearing: Approval of Final Budget
Chairwoman Overfield opened the public hearing. Clerk Renner read the resolutions into the record. Approval of Resolution Amending 2022-23 Fiscal Year RESOLUTION 2023-38; Approval of Annual Appropriation for Maintenance & Operation FY23-24 RESOLUTION 2023-39; Approval of Income Necessary to Finance Park County FY23-24 RESOLUTION 2023-40. Mr. Pomajzl stated the mineral tax reserves paid early will be held out into next year’s budget.
Chairwoman Overfield called for public comments, there being none, Commissioner Thiel moved to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Mangold moved to approve the final budget, Commissioner Steward seconded, motion carried.

Joy Hill, Planning & Zoning Director – RE: Public Hearing: Trout Creek Ranch Floodplain Permit 4-23
Chairwoman Overfield opened the public hearing.
Ms. Hill presented John Heine, Morrison Maierle on behalf of Trout Creek Ranch which is requesting a streambank stabilization/restoration project along 250 feet of rapidly retreating bank line on the north bank of the North Fork of the Shoshone River. Public notices and agency referrals have been met with no public comments received. At this time US Army Corps or Engineers have not approved. Ms. Hill read the seven recommendations into the record removing #1 as it was met.
Chairwoman Overfield called for public comment. Mr. Reed, Morrison Maierle and Fred Burgin made comments. There being no further public comments Commissioner Mangold moved to close the public hearing, Commissioner Thiel seconded, motion carried.
Commissioner Mangold moved to approve with seven staff recommendations, Commissioner Thiel seconded, motion carried. RESOLUTION 2023-41
Kim Dillivan, Planning & Zoning Assistant Director – RE: Public Hearing: Bontrager SUP-252
Chairwoman Overfield opened the public hearing.
Mr. Dillivan presented a SUP for Marvin Bontrager which included a site map, vicinity map, site plan and floor plan document. This SUP is to operate a business that will entail the construction of equine shelters, small barns, and livestock sheds. The property is located 5 miles southeast of Powell on Lane 11 in GR-P zoning. Notices and agency referrals have been met and no public comments received.
Staff recommends approval with conditions read into record. Chairwoman Overfield called for public comments. Commissioners questioned storage and structures remaining on property.
No further public comments, Commissioner Thiel moved to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Thiel moved to approve the permit with staff recommendations modifying #4 to read 60 days, Commissioner Steward seconded, motion carried. RESOLUTION 2023-42
Kim Dillivan, Planning & Zoning Assistant Director – RE: Public Hearing: Himes Homestead MS-75 Sketch Plan
Chairwoman Overfield opened the public hearing.
Mr. Dillivan presented the minor subdivision sketch plan from Ron and Penny Himes to approve a three-lot subdivision consisting of one 34.11-acre lot, one 2.5-acre lot and one 3.05-acre lot for agricultural and residential use. Zoning is GR-P and the property is location three miles southeast of Powell. Notices and agency referrals have been met with no public comments received.
Staff recommends approval with 14 recommendations read into the record, striking #7.
Chairwoman Overfield called for public comments. Ron Himes owner stated he has not heard from Willwood Light & Power but will have for final plat.
Commissioner Mangold moved to close the public hearing, Commissioner Steward seconded, motion carried.
Commissioner Mangold moved to approve sketch plan with 13 recommendations stated by staff, Commissioner Thiel seconded, motion carried.
RESOLUTION 2023-43
Kim Dillivan, Planning & Zoning Assistant Director – RE: Mollett SS-302 Final Plat
Mr. Dillivan presented the final plat for Arnold and Vicki Mollett requesting approval for a two-lot subdivision resulting in one 10.01-acre lot, one 10.03-acre lot and a 133.38-acre remainder parcel. The zoning is GR-35 in Clark and is 5.7 miles west of Hwy 294 and the Belfry Hwy in Clark. Notices and agency referrals have been met with one comment in opposition to 10-acre lots being allowed. Responses from BLM regarding access and Mr. Mollett stated he paid the fee for 10 years. Staff recommends approval with two conditions read into the record and road access also addressed on the plat.
Commissioner Mangold moved to approve with staff recommendations, Commissioner Thiel seconded, motion carried. RESOLUTION 2023-44
Kim Dillivan, Planning & Zoning Assistant Director – RE: Public Hearing: Homestead Campground SUP-192 (Amendment Request)
Chairwoman Overfield opened the public hearing.
Mr. Dillivan presented the SUP to amend the existing SUP to add a potable water system and wastewater system to the existing campground. In November 2021, a notice of violation was given to the Youngs regarding water and septic being provided to guests which was not allowed in the SUP. The planning office and DEQ have been working with the Youngs to come into compliance with the well that is already present on the property. The Planning Director determined that the proposed changes are not minor, and conditions stated in Resolution #2020 – 04 specifically required an amendment to the SUP upon installation of water and sewer services. Notices and agency referrals have been met and one public comment in support was received.
Chairwoman Overfield called for public comments.
Bill Young, Mary Campbell and Karen Young and Amanda Sievert made comments. After discussions on usage, not UIC, not potable water and spickets located at each camp site. Ms. Young stated fire rings are at each site and after a house fire in the area thought it would be wise to have water availability at each site, the septic system is not in yet. Commissioner Thiel made a motion to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Steward questioned condition #2 and #17 regarding wildlife. Commissioner Steward made a motion to approve the updated SUP with conditions # 2 and 17 removed, Commissioner Thiel seconded, motion carried. RESOLUTION 2023-45
Executive Session.
Commissioner Thiel made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (iii), Commissioner Mangold seconded, and motion carried.
Commissioner Mangold moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in or as a result of the executive session.
EJ House, Cody Chamber President & CEO – RE: Chamber Update
Mr. House updated the Board on Chamber happenings. There was a great turnout for 4th of July. Great comments from visitors with regards to the 47 vendors and food trucks. Buffalo Bill Art Show which is a Chamber event along with Buffalo Bill Center of the West where portraits are displayed for purchase or on-line buying. A new event will be Cody Run the Runway on August 30 with proceeds to benefit the development of commercial air service. Mr. House also thanks the Board for participation Cody Club lunches. Mr. House also gave some statistics on visitors showing a 4% increase.
Mayor Matt Hall, City of Cody – RE: Park County Complex
Mayor Hall presented thoughts regarding a convention center availability within Park County. Bruce Sauers, Buffalo Bill Center of the West and Ryan Hauck, Travel Council Director also spoke with how much more Park County could offer to larger groups if a larger space were available and how much that would generate economic growth for the County.
Mr. Sauers spoke about the growth happening with the Winchester Firearm Show which sold out this year with 333 tables by April which could have been larger had the space been available. Mr. Hauck stated with a proper facility there could be groups of 500-600 come for different association groups during the off season.
Mayor Hall would like to work on potentially making a part of the Park County Complex a convention center using the second and third floors. After discussions on the concept, it was decided to have a structural engineer work with the City and County Engineers to see if the building can structurally handle this type of facility before moving forward with the proposal.
The Other Project (TOP) – RE: Cody Active Transportation Master Plan
Tiffany Manion, Janie Curtis, and Chris Guyer presented the plan which creates a roadmap for non-motorized pathways in the Cody community. The group would like to have someone from the County and the Board appointed Brian Edwards to represent the County.
Cody Beers, WYDOT Public Relations Specialist – RE: WYDOT State Transportation Improvement Program Meeting
Pete Hallsten, District Engineer gave updates on current projects. The Crosswalk on Big Horn Avenue, signal light at Blackburn, and turning lane near Corbett Bridge. District 5 has 6,731 miles of roadway most of which is two lanes. Inflation has delayed some projects. Current projects are redoing the lighting in the tunnels with new carbon monoxide detection and pedestrian style button push which flashes to notify drivers of someone in the tunnels, paving around the reservoir, Bridge on Hwy 120 rehabilitation work, mud flows on North Fork and repainting crosswalk on Big Horn Avenue.
Randy Merritt, Construction Engineer spoke regarding projects for upcoming years beginning in 2023-2029. Fence project on Skull Creek, paving 8.5 miles in Crandall area, right turn lane 2 AB, paving on North Fork, Chief Joseph Hwy, Meeteetse south to rest area, Powell to Ralston, Town of Meeteetse upgrade for ADA compliance to name a few. Brian Edwards and Stephanie Bell made comments. Mr. Hallsten thanked the Board for the relationship and how the Board evaluates and looks at impacts and infrastructure.
