Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, January 21, 2020. Present were Vice Chairman, Lee Livingston, Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner.
Brian Edwards, County Engineer led the audience in the Pledge of Allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Commissioner Fulkerson made a motion to approve the following consent agenda items: minutes from January 17, 2020, bi-weekly payroll in the amount of $439,879.52, vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff, approve and Chairman Sign FFY2020 Q1 TANF/CPI Report & Vouchers; approve and Chairman Sign the Park County and ERG NRMP (Natural Resource Management Plan) Contract. Commissioner Livingston seconded, and the motion carried.
Commissioner Fulkerson made a motion to approve and Chairman Sign CMAR (Construction Manager at Risk) Agreement for Park County Coroner Building once the document is approved by Attorney Skoric, Commissioner Livingston seconded, and motion carried.

Park County Clerk, Colleen Renner – RE: Approve and Sign Consensus Funding Resolution and Request Primary & General Election meeting dates changed.
Commissioner Overfield made a motion to approve and allow the chair to sign the application for the County Wide Consensus Funding still available to Park County, Commissioner Thiel seconded, and motion carried. RESOLUTION 2020-02
Clerk Renner also requested that the Commissioner meeting dates that coincide with the Primary and General Elections be moved from August 18 to August 19 and November 3 to November 4. Commissioner Livingston made a motion to shift their regular meeting dates by one day, Commissioner Thiel seconded, and motion carried.
Park County Deputy Clerk, Hans Odde – RE: Open Bids for Park County Planning & Zoning Vehicle
Mr. Odde stated only one bid has been received from Denny Menholt and had three submissions. The funding available to purchase this vehicle is $13,950 which comes from payoff on the wrecked planner’s vehicle, compensation from the counties insurance replacement policy and the budgeted $5,000 deductible.
The bids are as follows:
• Used 2018 Equinox, 47,138 miles for $19,995.00 minus $5,000 for the 2005 Tahoe trade-in - net bid $14,995.00;
• New 2020 Equinox LT, $27,684.00 minus $5,000 for the 2005 Tahoe trade-in - net bid $22,684.00; and
• New 2020 Equinox LS, $23,194.00 minus $4,500 for the 2005 Tahoe trade-in - net bid of $18,694.00.
Commissioner Fulkerson recommended a review of the bids with the planner and return later for a decision.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Alkali Creek Simple Subdivision Sketch Plan Review – 258
Mr. Dillivan presented the Final Plat of Ricardo Rodriguez which divides a 110.7-acre parcel into two lots with propose Lot 1 being 15.099 acres, Lot 2 being 14.74 leaving a remainder parcel of 80.87 acres. The property is located three miles northwest of Ralston. A public hearing is not required for final plat review and no public comments were received.
Planning & Zoning recommends approval with a note on the final plat regarding the high nitrogen found in the water sample, modifications may be required due to high ground water levels for septic systems and easements must also be identified.
Commissioner Fulkerson made a motion to approve the final plat as presented, Commissioner Thiel seconded, and motion carried. RESOLUTION 2020-03
Deb White, Healthy Is Representative – RE: Park County Healthy Is Report
Ms. White presented a summary to the board reporting a high level of participation among county employees. Ms. White presented data on one department’s lack of participation, hours saved in sick leave, total pounds lost, along with other findings. The Board will consider continuing this program during one of the February meetings.
Park County Landfill Manager, Tim Waddell – RE:
• Approve and Chairman Sign One Year Renewal Roll-Off Services Park County Regional Landfill Citizens Convenience Center Contract Agreement
Commissioner Thiel made a motion to approve and sign the one-year renewal, Commissioner Livingston seconded, and motion carried.
• Discussion on Park County Landfill Minimum Fee vs Scale Fees
After discussing the fees and the possible amounts that could be collected Commissioner Fulkerson made a motion to charge the minimum fee of $5.00, Commissioner Livingston seconded and asked what the effective date would be, Mr. Waddell would like to make it effective March 1, 2020, and motion carried.
Park County Commissioners – RE: Reconsideration of the Park County Webpage Update
Commissioner Fulkerson has heard an outcry from the public regarding the cost for a new website. No contracts have been signed with the initial bid winner. Commissioner Fulkerson made a motion to have Mr. Conners and staff develop a new website, Commissioner Livingston seconded, and motion carried.
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (iii), Commissioner Thiel seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Homestead Campground SUP – 192 with Site Plan Review
Chairman Tilden opened the public hearing.
Mr. Dillivan presented a site plan for review for a campground comprised of 14 sites. The property is located within a GR-5 zone which allows moderate-intensity land uses, approximately 20 miles west of Cody and is on the North Fork. Legal notices and agency referrals have been met and comments from Game & Fish, North Fork Valley Ditch Company, Fire District #2, PacifiCorp and WYDOT have all been reviewed. No public comments have been received.
Mr. Dillivan stated no signs are proposed, operation will be May 1 through October 31 with office hours from 8 a.m. to 10 p.m., there will be no electrical service, water or sewer at this time, bearproof dumpsters will be provided, and only self-contained, hard-sided recreational vehicles permitted.
After discussion regarding hard-sided and self-contained campers, Commissioner Livingston suggested removing hard-sided and just leaving self-contained due to the lack of water or sewer services at this site.
Chairman Tilden called for public comments. Comments were heard from Bill Landwer regarding the road entrance, Alisa Acosta concerning a growth plan, Brian Cummins regarding access and Magdalena Siebert spoke in favor. There being no further comments from the public, Commissioner Fulkerson made a motion to close the public hearing and Commissioner Livingston seconded, and motion carried.
Commissioner Thiel made a motion to remove hard sided campers and approve the amended SUP, Commissioner Livingston seconded, and motion carried. RESOLUTION 2012-04
Park County Planning & Zoning Director, Joy Hill – RE: Steedley Notice of Fines – 3rd Consideration
Ms. Hill gave a history of this situation going back as far as 2017. In October 2019, DEQ stated the property could use a holding tank in place of a septic system. Mr. Tuckness was supposed to be handling this however he has failed to this point.
Ms. Steedley stated the hole for the holding tank has been dug and are awaiting the tanks arrival. Commissioner Thiel asked for a receipt and reminded Ms. Steedley that the tank will need to be inspected before back filling the hole.
Commissioner Thiel moved to allow an extension to the deadline for installation provided that the tank shall be in place by February 4 or fines will be accessed. Commissioner Livingston seconded, and motion carried.
Park County Planning & Zoning Director, Joy Hill – RE: Public Hearing - Brown Thomas Meadows, LLC FloodPlain Development Permit #1-20
Ms. Hill presented the application submitted by Mike McDonald on behalf of Brown Thomas Meadow to move a transformer to a new location and connect it to a housed generator which will feed power to two existing structures. Public hearing, neighbor and agency notices have all been met, no public comments received. The new structure will be 20 x 14 ft. to replace the existing structure with a waiver for the flow through venting.
Commissioner Livingston question the fuel source and the applicant stated it will be a diesel run generator securely welded.
Chairman Tilden called for public comment, there being none, Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Livingston made a motion to approve the flood plain permit as presented, Commissioner Overfield seconded, and motion carried. RESOLUTION 2020-05
Mr. Odde and Ms. Hill came with the documentation on replacing the zoning vehicle that was a total loss when side swiped. After discussion on the three vehicle bids received, Commissioner Livingston made a motion to purchase the 2020 Equinox LS costing an additional $4,744.00 after receiving the payoff and applying the $5,000 deductible, Commissioner Fulkerson seconded, Commissioner Thiel opposed, and motion carried.
Commissioner Thiel would like the possibility of not filling the Building & Grounds position for 90 days to 6 months re-discussed. Mr. Garza and Mr. Beavers were brought in for the discussion. Some facts presented were one county building is a 24-hour a day, 365 days a year facility, instances of safety were pointed out, this position does not affect the public it affects the care and maintenance of our county assets. There is one department head and five maintenance techs to take care of our facilities. After further discussion Mr. Garza was given the go ahead to fill the position.

Comments
