Chairman Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, February 1, 2022. Present were Vice Chairman, Scott Mangold, Commissioners Lee Livingston, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Ben McDonald led the audience in the Pledge of Allegiance.

Commissioner Livingston made a motion to approve the following consent agenda items and remove the updated fee schedule: minutes from January 18; bi-weekly payroll in the amount of $610,169.60; vouchers; sign LegacyWorks Contract; Review and Sign Lease Renewal for McCarty, Reed and Earhart; sign Clarion contract for the Land Use Plan update; review and sign BLM Letter to be cooperating agency in EIS. Commissioner Tilden seconded and the motion carried.

Brian Edwards, Engineer, Public Works Department – RE: Open Bids for solid waste roll-off services
Mr. Edwards stated there were two bids received.

Brian Edwards, Engineer, Public Works Department – RE: Consider application for Transportation Alternatives Program (TAP) funding for engineering and construction Phase 1 Powell Area Pathways
Mr. Edwards reported the history of the project and what the next steps are in the application process, if the grant were awarded to Park County it is an 80-20 match with WYDOT and would begin by moving forward with engineering. Some concerns are the irrigation, utilities, safety of pedestrian and bike traffic usage. The total project could cost over 2 million and be completed in phases. Mr. Edwards feels this is a viable project for the outskirts of Powell and could eventually continue all the way to Homesteader Park and the high school. Commissioner Livingston made a motion to make application for the TAP funding, Commissioner Tilden seconded, motion carried.
Patti Umphlett & Jenny Cramer, Planning & Zoning – RE: Cooper SS-281 Final Plat
Ms. Umphlett reported on the final plat application signed by Nick and Rachael Handley requesting approval of the final plat for one 6-acre lot for residential use and will contain an exempt remainder parcel of 59.58-acres. The proposed lot is located 4.5 miles west of Ralston and 1.2 miles west of Hwy 294 in zoning GR-P. The parcel is currently vacant irrigated farmland. Notices, agency referrals and conditions have been met, no public comments received.
Commissioner Tilden made a motion to approve Cooper SS 281 final plat with staff recommendations, Commissioner Thiel seconded, motion carried. RESOLUTION 2022-11
Patti Umphlett & Jenny Cramer, Planning & Zoning – RE: La Blue SS-277 Final Plat
Ms. Umphlett stated final plat application received from Coby & Arend LaBlue requests approval for a subdivision comprised on one 3.0-acre lot for residential use, resulting in an exempt remaining parcel of 37.05 acres. The proposed is located 2.75 miles northeast of Powell and 1.3 miles east of County Road 8 and Lane 6 in zoning GR-P. Notices, agency referrals and conditions have been met, no public comments were received.
Commissioner Livingston moved to approve as presented with one staff recommendation, Commissioner Mangold seconded, motion carried. RESOLUTION 2022-12
Patti Umphlett & Jenny Cramer, Planning & Zoning – RE: Willwood Dam MS-61 Final Plat
Ms. Umphlett stated final plat application received from Daniel Martin requests approval for a three-lot subdivision consisting of one 5.6-acre lot and two 5.08-acre lots all for residential use. The proposed subdivision is located 5.25 miles southwest of Ralston and 1.6 miles southeast of Hwy 14A in zoning district GR-P. Notices and agency referrals have been met, no public comments received. Water Right status have been met and Willwood Irrigation Canal stated the property has no water rights.
Commissioner Mangold moved to approve, Commissioner Livingston seconded, motion carried. RESOLUTION 2022-13
Brooks Jordan, Big Horn District Manager, Wyoming State Parks – RE: Upcoming Buffalo Bill State Park master plan process & Overall capacity expansion effort projects
Mr. Jordan introduced Mr. Marty, Park Supervisor and presented the Board with an update on the master plan. The Bartlett Lane area was very contentious, and expansion will be looked at in other places like Stagecoach or possible expansion of the North Fork campground. The park has seen a 35% increase in use since 2020. Further information on the RMP process and a resource master plan were discussed. Commissioner Livingston requested that the Park County Commissioners be granted a seat at the table during this planning effort. Chairman Overfield asked about the time frame for the planning process, Mr. Jordan thought 6-9 months from start to finish.
Brian Edwards, Engineer, Public Works Department – RE: Consider award of contract for solid waste roll-off services
Mr. Edwards stated this is a one-year contract and recommends staying with Keele Sanitation.
Commissioner Tilden made a motion to approve Keele at the proposed one-year rates, Commissioner Thiel seconded, motion carried.
Patti Umphlett & Jenny Cramer, Planning & Zoning – RE: Patriot Major Subdivision Final Plat
Ms. Umphlett stated final plat application received from Jim Nicholson for a 13-lot major subdivision consisting of lots varying in size from 1.0 to 2.14 acres, each designated for residential use. The proposed location is 1 mile west of Powell and .65 miles north of Hwy 14A in GR-P zoning. The City of Powell approved the subdivision plan on February 22, 2021. No public comments were received. On January 18, 2022 the Board addressed the violation on this property. Final plat specifications have all been met and final documents submitted.
Commissioner Livingston moved to approve as presented, Commissioner Tilden seconded, motion carried. RESOLUTION 2022-14
Predator Management Advisory Board Interview – Chairman Overfield stated to each applicant that there are two openings on the Predator Management Board one sportsman and one at large position to be filled. The following were interviewed for the openings.

• Clint Griffis (11:45 a.m.)
Commissioners – RE: Public Hearing to consider appeals of Park County Engineer’s decision to grant administrative relief from certain Park County Road Design and Construction Standards to the applicant of the proposed Jody Lane Minor Subdivision MS-63.
Chairman Overfield opened the public hearing and requested that those speaking on the appeal not repeat what has already been said.
Lonnie (Russ) Whitlock, Wilson Crawford spoke in objection of granting administrative relief to the Jody Lane developers and written comments from Colton & Maddison Hodson were also received in objection.
Cody Schatz, Engineering Associates clarified a few issues and Ben McDonald and Brian Edwards, Public Works also made comments.
Chairman Overfield called for public comments one last time and Phil Campbell commented would like to see the group figure it out without government involvement.
Commissioner Livingston made a motion to close the public hearing, Commissioner Tilden seconded, motion carried.
After lengthy discussions and not all questions being answered Commissioner Livingston requested that no action be taken at this time and schedule February 15th at 10 a.m. to further discuss and decide on the appeals.
Commissioners – RE: Discussion on Northern Rockies Ecosystem Protection Act
Commissioner Thiel shared a resolution that adds 6,514,000 acres to the national wilderness system in the Greater Yellowstone Ecosystem regardless of the suitability and failure to meet the wilderness criteria outline in the 1964 Wilderness Act.
After discussion Commissioner Thiel made a motion to approve a resolution opposing HR1755, Commissioner Tilden seconded, motion carried. RESOLUTION 2022-15
Cody Conservation District – RE: Special Election for Mill Levy
Chairman Overfield stated two weeks ago the Cody Conservation District presented a petition requesting that Park County hold a Special Election in May to consider assessing one mill of property tax to fund the district.
Mr. Odde, First Deputy Clerk & Elections Deputy met with Mr. Vanata, Clerk Renner, and Chairman Overfield and stated that the time frame is tight however the elections office could administer the election. Mr. Odde stated that this could be conducted as a mail ballot election to 9,821 voters in the Cody Conservation District. About 18 election judges, 6 teams of three, to check in, open and run the ballots through the central counting machine would be needed. Total cost would be approximately $22,215.00 and the department does not presently have this expense in the budget and an amendment would be needed.
Mr. Vanata stated there are only two conservation districts in Wyoming that are not funded by a mill levy. If the district had a reliable source of income the board would have the ability to do what they were created for. (CodyConservationDistrict.com)
Commissioners agreed that the Conservation District does good work and is a needed service but cannot justify and additional cost for a Special Election when the question can go to the voters on the Primary or General Ballot. Commissioner Livingston made a motion to deny the request but is in favor of them putting it on the Primary or General Ballot, Commissioner Mangold seconded, motion carried.
Brian Edwards, Park County Engineer, Public Works Department – RE: Consider contract award for construction services to replace weight scale at the Powell Landfill
Mr. Edwards stated this is the second go around for bids on the scale system replacement at the Powell Landfill. Only one bid from Two Sisters was received in the amount of $125,362.26. Mr. Edwards recommends we accept the bid and allow the chairman to sign once Attorney Skoric approves the contract. During the project the scale might be down a week or two and hand tickets will be used.
Commissioner Livingston made a motion accept bid and allow chairman to sign contingent on county attorney approval, Commissioner Thiel seconded, motion carried.
Predator Management Advisory Board Interview – Continued –

Kyle Garrett, Large Carnivore Biologist, WY Game & Fish Department – RE: Carcass Management Presentation
Mr. Garrett stated he is new to the position, started last August and responsible for the carcass removal program that was first implemented in 2008. The program is dedicated to removing local ranchers’ dead cows in designated areas of Park County to decrease bear conflict. Game & Fish at this time owes the Landfill $2,400 for disposal of the carcasses and is here today to ask for forgiveness of that debt.
Commissioner Thiel not a proponent and feels producers should pay this cost, Commissioner Mangold stated Powell area has issues with carcasses being left and not taken to the landfill. Ms. Morris, Landfill representative stated the fees are $18.00 for 200 lb. animal or $6.00 for an animal under 200 lbs. Commissioner Tilden stated the goal of this program was to get the grizzly delisted.
Commissioner Livingston made a motion to forgive debt of $2,400 for the carcass program through Game and Fish, Commissioner Mangold seconded, motion carried with Commissioners Thiel and Tilden opposed, Chairman Overfield voted aye.

Commissioner Livingston made a motion to reappoint to sportsman Jacob Jarrett and member at large John Jerkins, Scott seconded.
Discussion Commissioner Thiel would like to have Clint Griffis as at large, with discussion Commissioner Livingston withdrew his motion.
Commissioner Livingston made a motion to appoint Jacob Jarrett for sportsman position, Commissioner Mangold seconded, motion carried.
Commissioner Thiel made a motion to appoint Clint Griffis for the at large position, motion died for lack of a second.
Commissioner Tilden made a motion to appoint John Jerkins for the member at large, Commissioner Livingston seconded, Commissioner Thiel opposed, motion carried.
