Chairman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, December 19, 2023. Present were Vice Chairman, Lloyd Thiel, Commissioners Lee Livingston, Scott Mangold, Scott Steward and First Deputy County Clerk Hans Odde.
Kari Smith led the audience in the pledge of allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Commissioner Thiel requested that the vouchers be considered separately from the consent agenda, Chairman Overfield granted the separate consideration.
Commissioner Livingston made a motion to approve the following consent agenda items: minutes December 5, 2023; elected’s payroll in the amount of $102,600.98 which includes health insurance; employee payroll in the amount of $509,227.96 which does not include health insurance; approve monthly earnings and collections statements from the Clerk, Clerk of District Court, and Sheriff. Commissioner Thiel seconded and the motion carried.
Commissioner Thiel explained his request to remove the vouchers from the consent agenda as his personal business is being paid for a quantity of gravel that he sold to the county.
Commissioner Livingston made a motion to approve the vouchers as presented. Commissioner Steward seconded and the motion carried. Commissioner Thiel abstained.

Re: Continued Public Hearing: DAC LLC New Full Retail Liquor License
Second Deputy County Clerk, Kari Smith reported that the State Liquor Division has completed their review and approved the DAC LLC retail license application and supporting documents.
Chairman Overfield noted that she contacted WYDOT regarding the highway access permit filed by DAC LLC and found that it has been denied. Also, the permit application listed the business as storage units rather than a liquor store. Owner of DAC LLC, Dustin Taylor explained that the future parcel will be just less than four acres and his plan is to eventually add storage units to the back of the lot. Chairman Overfield also questioned the pending subdivision application that states the land use is residential and Mr. Taylor responded that his engineer filed the application, and he was unaware of that and will check on it with P&Z. Mr. Taylor will continue to work though the access and subdivision processes.
After calling for further public comment and hearing none, Commissioner Livingston made a motion to close the public hearing. Commissioner Thiel seconded and the motion carried.
Commissioner Steward made a motion to approve the retail liquor license for DAC LLC dba Mountain Liquor in the current intended location and in a parked status until all other conditions are met. Commissioner Livingston seconded and the motion carried.
Joy Hill, Park County Planning Director
Re: Pelletier Consideration of Penalties
Assistant Planning Director, Kim Dillivan informed the Board of the history of the Ralston property in question owned by Christopher and Anita Pelletier.
Staff spoke with Mr. Pelletier about the uses occurring on his property at 557 Main Street in Ralston. During two conversations, staff learned that the following uses were operating on the Property: Heart Mountain Hearing Center (for 14 years), Mobility Plus (in the process of moving to the City of Powell), and Pioneer Sheds shed displays/sales. Mr. Pelletier indicated that he wasn’t sure if his septic system was working properly – there had been a pipe repair done at some point in time and he gets the tanks pumped more frequently since that time. In the meantime, Mr. Pelletier has leased the former Mobility space to an unauthorized and unpermitted dog grooming business that has resulted in a Notice of Consideration of Penalties letter being sent by P&Z that explains the violations as well as the permitting requirements.
Mr. Pelletier stated that he would hire a plumber to evaluate the operational viability of the septic system and ask the shed business to move from the property so there will only be two businesses on the parcel. He will also work with P&Z to get the dog grooming business permitted and the commissioners agreed to allow this business to continue operating while working towards compliance.

Re: Fair Board
Chairman Overfield explained that a statutory change in 2022 defined the method of how county boards could be dissolved including fair boards. The Park County Fair Board was dissolved in 2015 and now it is the desire of the Board of County Commissioners to reinstate a fair board.
Commissioner Livingston made a motion to approve a resolution reinstating the Park County Fair Board and appointing the Park County Board of County Commissioners as the fair board, terms to run concurrent with each commissioners elected term. Debra Carroll, Park County Clerk of District Court
Re: Cooperative Agreement with State of Wyoming
Clerk of District Court Carroll presented for consideration the two-year Wyoming Department of Family Services Child Support Program agreement which has been reviewed and approved to form by the County Attorney and State’s Attorney General.
Commissioner Livingston made a motion to approve and allow the Chairman to sign the agreement as presented. Commissioner Mangold seconded and the motion carried.
Brian Edwards, Park County Engineer, Public Works Department
Re: Bid Opening for (2) Dump Trucks and (1) Heavy Haul Tractor
Mr. Edwards opened bids from Peterbilt of Wyoming, Floyd’s Truck Center and McCandless Truck Center for two dump trucks. Peterbilt of Wyoming bid a model 548 with Kois Brothers upfit for $307,407.00 each, $85,000 for the proposed trade-ins; and the same model with an Ameritech upfit for $313,562.00 each. Floyd’s bid a Western Star model 47X with three different upfits; Kois Brothers - $289,626.00 each, Ameritech - $289,546.00 each and J. Craft – $293,546.00 each and $110,000.00 for the trade-ins. McCandless bid an International model HD613; with the Kois Bothers upfit for $290,290.00 each, and the Ameritech upfit for $296,374.00 each and $30,000.00 for the two trade-ins.
Mr. Edward then proceeded to open bids from Peterbilt of Wyoming, Floyd’s Truck Center and McCandless Truck Center for one heavy haul tractor truck. Peterbilt of Wyoming bid a model 567 for $207,234.00. Floyd’s bid a Western Star model 49X for $189,994.00. McCandless bid an International model 8X620 for $206,640. Peterbilt of Wyoming also offered a 2017 Peterbilt with 453,000 miles for $155,000.00 as an alternative.
Mr. Edwards will review the bids in detail and return to the January 2, 2024 meeting with a recommendation for award.

Re: Adjacent Landowner Fencing Consent Form
Chairman Overfield met with the County Attorney to review a form developed by P & Z to provide to landowners who are subdividing land that will now be required by a new statute to be fenced if the subdivision is adjacent to lands upon which livestock can be legally run at large. This form is meant to obtain the adjacent landowner’s consent to NOT fence when a fence is not necessary for the subdivision. The Chairman went on to explain that the board will have to consider each of these on a case-by-case basis with each subdivision. The Commissioners agreed to accept the form as presented and have P&Z begin using it immediately.

Re: Board Interviews
The Commissioner conducted the following interviews: Park County Planning and Zoning Commission – Linda Stokes did not attend; Buffalo Bill Dam Visitor Center Board – Dave Jenkins; Park County Fair Advisory Board – Randi Mclaughlin, C. Daniel Schein Jr., Theodora “Teddy” Jones; Meeteetse Local Planning Area Advisory Committee – John David Lundberg. Board members who reapplied as incumbents were not interviewed.
Commissioner Livingston made a motion to appoint Dave Jenkins and Greg Irwin to the Buffalo Bill Dam Visitor Center Board. Commissioner Thiel seconded and the motion carried.
Commissioner Thiel made a motion to appoint Dunkin Bonine to the Planning & Zoning Commission. Commissioner Livingston seconded and the motion carried.
Commissioner Livingston made a motion to appoint Mary Rumsey, Joeseph Wagers, Tiffanie May and John Lundberg to the Meeteetse Planning Area. Commissioner Steward seconded and the motion carried.
Commissioner Mangold made a motion to appoint Brian Beauvais and Fran Scranton to the Park County Historic Preservation Commission. Commissioner Livingston seconded and the motion carried.
Commissioner Livingston made a motion to appoint JP Jones and Andrea Earhart to the Park County Fair Advisory Board. Commissioner Mangold seconded and the motion carried.
Ryan Hauck, Executive Director, Park County Travel Council
Re: Film Commission Office for Park County
Mr. Hauck approach the commissioners asking for support to create a film office within the Park County Travel Council. The goal of the film office would be to recruit production companies to come to the Park County area to produce audio and visual media.
Commissioner Livingston made a motion to approve the resolution supporting an application to become an official film office pending approval as to form from the County Attorney. Commissioner Steward seconded and the motion carried. Resolution #2023-70
William Wood, Park County Events Coordinator
Re: Updated Rental Agreement
Mr. Wood presented the updated facility rental agreement and fee schedule for consideration.
Commissioner Livingston made a motion to approve the new rental agreement with one amendment to add “Park County has the right to turn away or deny any event”. Commissioner Steward seconded and the motion carried.
Commissioner Mangold made a motion to approve the fee schedule as presented. Commissioner Livingston seconded and the motion carried.
