With President-elect Donald Trump we might be tempted to assume our constitutional rights are no longer in jeopardy. Agreed, we can probably relax for at least the next four years but then all bets are off.
We heard a lot of chatter about “packing the Supreme Court” from the Biden administration. They can’t pursue it now, but there is nothing stopping the next Biden-like administration from increasing the number of Supreme Court justices to 13 then filling it with justices less than friendly to the spirit of the U.S. Constitution. Once packed, the outcomes of lawsuits challenging our right to free speech, free exercise of one’s religion, freedom to peaceably assemble, freedom of the press and the Second Amendment are unlikely to be favorable.
The only thing that can prevent an administration unfriendly to the Constitution from packing the Supreme Court is an amendment to the United States Constitution limiting the number of justices to nine. Congress will never propose that amendment, but through a convention for proposing amendments outlined in Article V of the U.S. Constitution, the states can. Our Wyoming state legislators have the duty, authority and responsibility under the U.S. Constitution to ensure the federal government can’t do what the current administration has threatened to. Wyoming legislators need to act in 2025 and support Wyoming joining the call for a Convention of States to propose amendments that term limit federal officials, impose fiscal restraint, and reduce the power of the federal government to do things like pack the Supreme Court.
