Utah fugitive found sleeping in snow in downtown Powell

When police checked on a man sleeping on Bent Street late one night last week, they found he was not only heavily intoxicated but also wanted by authorities in Utah.

Yanio B. Palomo, 48, of Orem, Utah, is now being held in the Park County Detention Center while waiting for Utah authorities to pick him up. Law enforcement officials in the Beehive State had been seeking Palomo’s arrest since last month, alleging that he violated the terms of his probation on a felony DUI conviction.

Palomo was arrested in downtown Powell early Thursday morning, after a passerby reported that someone appeared to have passed out in front of Heart Mountain Realty. Summoned to the scene around 12:41 a.m., officers found a man clad in an orange reflective coat and lying on the ground, said Powell Police Chief Roy Eckerdt; he was using a pile of snow as a pillow.

When officers went to rouse the man, “he was incoherent,” Eckerdt said, and they were unable to get his name.

Police initially summoned an ambulance as a precaution, but later canceled the request, as the man began responding to them and showed improvement, Eckerdt said.

Palomo was arrested on suspicion of public intoxication and registered a 0.294% blood alcohol concentration on a portable breath test administered at the police station, the chief said.

Eventually, the man was identified as Palomo and local authorities saw he was wanted in Utah. A district court judge in Utah County had placed Palomo on probation in December for a felony DUI conviction. However, just a month later, law enforcement officials alleged that Palomo had violated the terms of his probation. A judge issued a warrant for Palomo’s arrest on Jan. 9, recommending he be held without bail until he appears back in court in Utah County.

At his initial court appearance in Park County Circuit Court last week, Palomo declined to waive extradition, which could require Utah authorities to go through a longer, formal extradition process to have him returned.

Circuit Court Judge Bruce Waters set Palomo’s bail at $50,000 cash while he awaits Utah authorities. Palomo remained in the Cody jail on Wednesday.
