AN ORDINANCE ENACTING SECTION 5.08.095 OF THE POWELL CITY CODE BY ESTABLISHING A NEW POWELL CITY CODE SECTION THAT CONSOLIDATES PRIOR LANGUAGE IN THE CODE CONCERNING RESTRICTIONS ON PERMITS IF TO BE UTILIZED IN OR UPON A FACILITY OWNED, OPERATED OR MAINTAINED BY THE CITY OF POWELL
IT IS HEREBY ORDAINED by the Governing Body of the City of Powell, Park County, Wyoming, as follows:
Section 1: Section 5.08.095 of the Powell City Code is hereby enacted to provide as follows:
Section 5.08.095. Restrictions for permits to be utilized in or upon a facility owned, operated and maintained by city.
If a malt beverage permit, catering permit, or manufacturer’s off-premise permit is proposed to be utilized in or upon a facility owned, operated or maintained by the city, a clean-up deposit of $100.00 shall be posted with the city clerk’s office prior to issuance of the permit. A permit in or upon city owned, operated or maintained facility shall be prohibited, other than Washington Park, Homesteader Park and Southside Park only and facilities include the Commons and Plaza Diane. Requests for said permits must have prior approval of the city council. Additionally, any malt beverage, catering or manufacturer’s off-premise permit for those public rights-of-way within the city must have a waiver of open container which has been approved by resolution of the city council pursuant to section 9.08.070 B.. The deposit shall be returned if the facility or area is left in a clean and orderly condition. The city reserves the right to keep all or a portion of the deposit for actual cleanup costs incurred because of the permittee’s activities. The permittee shall strictly adhere to any requirements imposed by the city council, in addition to the laws of the state.
Section 2. This ordinance shall be in full force and effect upon adoption and publication as required by law.
