Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, May 9, 2023. Present were Vice Chairman, Lloyd Thiel, Commissioners Lee Livingston, Scott Mangold, Scott Steward and Clerk Colleen Renner.
Brian Edwards led the audience in the pledge of allegiance.
Brian Edwards, Park County Engineer, Public Works Department – RE: Open Sealed Proposals for CMAR Services for HVAC Upgrade/Replacement at the Park County Courthouse and Courthouse Addition
Mr. Edwards stated two proposals were received.
Groathouse Construction, Inc. design phase services bid is $10,000. The CMAR phase services would be 6% total cost of construction.
Sletten Construction design phase services bid is $18,000. The CMAR phase services would be 5.25% total cost of construction.
Mr. Edwards and Commissioner Thiel will interview and review the documents and comeback with recommendation May 16.
Park County Commissioners – RE: MOU for BLM Utility Scale Solar Energy PEIS
Chairwoman Overfield stated the MOU was written for the purpose of developing a draft and final Programmatic Environmental Impact Statement (Programmatic EIS) for utility scale solar energy development on BLM administered public lands. The MOU has been reviewed by Mr. Skoric, County Attorney. Mr. Skoric will discuss rights we have as written and obligations we have moving forward with Chairman Overfield.
Commissioner Livingston moved to sign the MOU, Commissioner Thiel seconded, motion carried.
Executive Session.
Commissioner Mangold made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (iii), Commissioner Thiel seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in the executive session.
Commissioner Livingston made a motion to adopt proposal as discussed in executive session and allow the chair to sign, Commissioner Thiel seconded, motion carried.
Adjourn.

Commissioner Thiel seconded and the motion carried.

Kim Dillivan, Park County Planning & Zoning – RE: Salmo Trutta Subdivision Final Plat
Mr. Dillivan presented the final plat application for Nicholas Grigas to vacate and re-subdivide Lot 20A of the amended plat of 4 Star Subdivision into two 5.06-acre lots, each for residential use. The parcel is located four miles southwest of Cody in GR-5 zoning on Moonlite Drive. Staff recommends approval with the four conditions which were read into the record.
Commissioner Mangold move to approve final plat with conditions, Commissioner Livingston seconded, motion carried. RESOLUTION 2023-20
Lisa Peterman, Crisis Intervention Services – RE: Special Funding Request
Ms. Peterman reported what has happened in the past year in providing services to victims of crime. The county funds are used to match Federal funding. The request for this year’s special funding is $11,000 and will be considered during the budget process.
Rebekah Burns, Powell Economic Partnership – RE: Special Funding Request
Ms. Burns reported that PEP continues to work on community development. The request for this year’s special funding is $24,000 and will be considered during the budget process.
Linda Dalton, Powell Senior Center – RE: Special Funding Request
Ms. Dalton presented statistics about the home delivery program and noted the increase over the past year on meals that are served as well as the programs the Center provides. The request for this year’s special funding is $55,000 and will be considered during the budget process.
Amanda Munn, Park County Animal Shelter – RE: Special Funding Request
Ms. Munn shared a power point presentation on the operation of the new facility and the cost of services provided to the county and surrounding areas. The request for this year’s special funding is $20,000 to $70,000 and will be considered during the budget process.
James Klessens, Forward Cody – RE: Special Funding Request
Mr. Klessens presented the annual report and gave a brief overview of the projects to grow the economy of the Cody area. The request for this year’s special funding is $20,000 and will be considered during the budget process.
Larry French and Larry Dodge – RE: Updated Presentation on Emergency Food Storage
Chairwoman Overfield stated that homeland security is searching throughout in the state for information regarding food storage programs already in place.
Mr. French presented a chart developed by Mr. Vaskis explaining to the Board the amounts of freeze-dried foods needed, availability, and calories to maintain a family of three with an estimated cost of $2,943,000.00 for 10,000 people for 30 days.
After further discussions Mr. French questioned how to request funding for this project. Chairwoman Overfield stated a little more buy-in from the community will need to be indicated to the board before they are willing to hear a proposal to use tax dollars to proceed.

Commissioner Thiel made a motion to enter executive session pursuant to W.S. § 16-4-405 (a), Commissioner Mangold seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Elfriede Milburn, Caring for Powell’s Animals – RE: Special Funding Request
Ms. Milburn and Ms. Marine presented a brochure to the Board and gave feedback on the operations of the facility this past year. They have done several fund-raising projects raising about $2,000. The request for this year’s special funding is $3,500 and will be considered during the budget process.
Park County Commissioners – RE: Continued Public Hearing: Be There Beartooth Ranch SUP-245
Commissioner Steward joined the meeting on-line via zoom.
Chairwoman Overfield opened the continuation of the public hearing and requested that only updated information be presented.
Austin Waisanen attorney representing the Hutton’s is concerned about attaching conditions on covenants, Section 11 states the Board has no power or obligation to enforce covenants and it would be unwarranted. Mr. Waisanen recommends an approval based on the four criteria stated in the Land Use Plan. Comments were also made from Gretchen & Scot Hutton, Carrie Satterwhite, and Mickey Case.
The Board asked staff about the expiration of the SUP, classification of commercial vs. institutional use. Ms. Hill read the definition of institutional use into the record. Ms. Hutton stated that in the future their family may take over the operation.
There being no further discussions Commissioner Mangold moved to close the public hearing, Commissioner Livingston seconded, motion carried. Commissioner Steward also voted “aye” by text.
Commissioner Livingston made a motion to approve as presented, Commissioner Mangold seconded. Discussions regarding insurance, issues with neighbors, accessing property to use the common area and Mr. Dillivan asked if the motion included the four conditions. Commissioner Livingston amended his motion to include the four conditions, Mangold seconded, Mr. Dillivan read the four conditions into the record. There being no further discussions motion carried, Commissioner Steward texted “aye”. RESOLUTION 2023-21
Park County Commissioners – RE: Old Faithful RV Park Site Plan Review
Chairwoman Overfield stated there were three questions left with applicant and staff for follow-up. The proximity of the Beirei well and septic, set back from river and set back from highway right of way.
Bret Reed, Engineering Associates stated it is approximately 370 feet to the Beirei well and septic. Mr. Reed also clarified the setback from the highway with regards to buildings, clarification is needed on the river setback however, Mr. Reed measured hillside and surface of ground. Several Commissioners felt it should be from high water mark and recommended a 100 ft. setback.
After discussions regarding the 19 conditions, set back from high water mark, current design changes that may modify the sketch plan, the applicant was requested to provide any changes in the plan. If there are major changes or if some requirements cannot be met Ms. Hill recommends another public hearing for the record.
Commissioner Thiel moved to approve the sketch plan with the stated conditions and adding a 20th condition stating that all conditions must be met before commencing the use and redefining condition 13 to be measured from high water mark by line of site, Commissioner Mangold seconded, Commissioner Steward texted “aye”, motion carried. Meg Nicholson, Meeteetse Senior Center – RE: Special Funding Request
Ms. Nicholson stated the center is running behind on funds due to increase food and wage costs. The request for this year’s special funding is $10,000 and will be considered during the budget process.
Park County Commissioners – RE: ARPA Discussion
Chairwoman Overfield would like to move forward with recommendations on the original ARPA/Covid money which needs to be spent by 2026. After discussions Commissioner Mangold made a motion to appropriate $2.7 million to the HVAC system, Commissioner Livingston seconded, motion carried.
