Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, May 7, 2024. Present were Vice Chairman, Scott Steward, Commissioners Lee Livingston, Scott Mangold, Lloyd Thiel and Clerk Colleen Renner.
Aaron Buck led the audience in the pledge of allegiance.

Commissioner Mangold made a motion to approve the following consent agenda items as presented: minutes April 16, 2024; payroll in the amount of $697,618.32 with insurance and elected pay for $102,401.09; vouchers; tentative budget by Clerk per W.S. §16-4-104(a); Catering Permit for Wyold West Brewing/Haworth Graduation; Lease Renewal for Granite Creek Energy, LLC; Allow Chair to Sign USDA Forest Service Agreement; Sign Wellpath Agreement 24-25; and Letter of Support for Willwood Irrigation, Commissioner Livingston seconded and the motion carried.

Kari Smith, Clerk’s Office – RE: Public Hearing: Absaroka Mountain Lodge Full Retail License
Chairwoman Overfield opened the public hearing.
Ms. Smith presented the application for the full retail license for Stephanie & Matt LLC. The applicants are current with state sales tax and in good standing, the Forest Service Lease should be available to us next week, so we are requesting approval pending receipt of the permit.
Chairwoman Overfield called for public comment, there being none, Commission Livingston made a motion to close the public hearing, Commissioner Steward seconded, motion carried.
Commissioner Livingston moved to approve with condition that the Forest Service permit be received prior to issuing the license, Commissioner Thiel seconded, motion carried.
Aaron Buck, Yellowstone Regional Airport Executive Director – RE: Airport Needs
Mr. Buck discussed law enforcement currently present at the facility helping with screening of passengers which is required by TSA and has been reimbursed in the past by TSA. Mr. Buck is requesting that the county provide a portion of the match for grant that covers these employees. In the past the City of Cody has paid 60% with the county covering 40%, which would amount to $16,000 this next budget year.
On May 1 this grant will no longer be available. Rules that apply for TSA are 5–15-minute response time from local law enforcement if an officer is not on site. Mr. Buck stated having an officer on site provides another level of security. Retired law enforcement is utilized for these positions and receive a badge through the Sheriff’s office and carry a firearm.
The Board will take Mr. Buck’s request into consideration for the upcoming budget.
Linda Dalton, Director of Powell Senior Center – RE: Special Funding Request
Ms. Dalton praised the transportation director receiving driver of the year, and a transportation van was purchased through donations. The Center was able to purchase 2-acres of land for a future expansion of the center. The cost of a new building is projected to be $6 million. Ms. Dalton also presented statistics about the home delivery program and noted the increase in services provided. The request for this year’s special funding is $60,000 and will be considered during the budget process.
Tina Bernard, Executive Director Youth Clubs of Park County – RE: Special Funding Request
Ms. Bernard stated the program serves about 100 kids in Cody and 85-90 in Powell. Many programs are offered throughout the year, the cost is $100 for the summer and $75 in the winter per child. Ms. Bernard requested special funding of $25,000 and will be considered during the budget process.
Brian Edwards, Engineer, Public Works Department – RE: Open Sealed Bids for Procurement of Drainage Materials Willwood Road Project Phase 1
Mr. Edwards stated the first phase of Willwood project will begin soon and one bid was returned for the supplies that will be needed. Ferguson Water Works was the only bid received. Cody Schatz, Engineering Associates stated they had some companies call interested in only bidding on some of the materials and Ferguson has bid all supplies for $162,779.58. Mr. Schatz will return with a recommendation.
Brian Edwards, Engineer, Public Works Department – RE: Consider Addendum to CMAR Agreement with Groathouse Construction for Courthouse HVAC to Consider Public Works Building
Mr. Edwards stated design is completed, interior of building estimates and roof replacement came in at $2.1 million. The other two buildings are nearing completion and is seeking an amendment to move forward with the public works building since it is vacated. Half of the estimated cost is already budgeted.
Commissioner Livingston made a motion to approve and move forward with the public works building, Commissioner Steward seconded, motion carried.
Commissioners – RE: Proposed Revised Lease Agreement with Verizon
Ms. Hill presented a lease and easement the Board approved in 2019 for a 35-foot tower which was not built. The building permit has expired, and a new one is needed to continue. The tower if approved will be located south of lot 9, Carter View Ranches Subdivision and an extension on the lease with conditions will need to be approved.
Commissioner Thiel made a motion with condition that the overall height with the lightning rod be under 35-feet, correction of the legal description and extend the lease 5 years Commissioner Livingston seconded, motion carried.
Park County Commissioners – RE: Wollschlager Consideration of Penalties
Chairwoman Overfield stated the situation outside of Powell with Mr. Wollschlager remains unresolved. Attorney Simpson representing Mr. Wollschlager stated photos taken on May 3rd were emailed to the Board. To date 34 cars, 7 campers and a motor home have been removed and taken to Billings for crushing which has cost $8,000. Several cars need minor fixes and then will be sold.
After further discussions on the property and conflicts that have happened Commissioner Steward questioned allowing a couple Commissioners with law enforcement on to the property so we can gauge how much progress has been made. Dates will be worked through Attorney Hill to allow access to the property. Mr. Wollschlager stated once everything is off the property it will be sold.
Alaina Doely, Crisis Intervention Services – RE: Special Funding Request
Ms. Doely, Assistance Director reported statistics on both the Cody and Powell Services. Crisis Intervention is requesting $12,000 that will be used for general operations. Fund Raising events are held throughout the year.
Jackie Fales, Park County Court Supervised Treatment Program – RE: Special Funding Request
Ms. Votaw is now the Board President and Ms. Fales is the Director. The funds requested are mainly used for state grant matches. Both Cities also help with funding to meet the matches. Beginning July 1, the program will be housed under the judicial branch instead of the health department and no changes are anticipated. The program is requesting $12,000.
Commissioners – RE: State Shooting Complex
James Klessens, Forward Cody and Sandy Newsome, State Representative, House District 24 updated the Board on the progress of Park County vying to be the location of the State Shooting Complex. The property is located south of Cody and is state owned with Hoodoo Land Corporation having a grazing lease. State Parks is willing to take the property and do the operations. Other topics of discussion were bringing competitions, revenue possibilities, competition market, amenities such as water and power, making a joint powers board to control the project and be the concessionaire. The group working on this plan has a mission and passion to get this done.
There are needs in the application process and are requesting funds from entities in the communities, travel council, cities, and county. Discussions on improving the access and bringing the road to county standards could be the cost the county will incur in this project.
Commissioner Livingston made a motion to provide $5,000 to the State Shooting Complex Committee, Commissioner Thiel seconded after some clarification on the next steps, actual road cost to be an action item on the third meeting, and the Board possibly touring the site the motion carried.
Mary Louise Wood, UW Extension Educator, 4-H/Youth Development – RE: Special Funding Request
Ms. Wood has increased the amount requested by $1,000 from last year. Park County is now one of the top three programs in the state. She also provided updates on the shooting sports program and was asked about fundraisers which the major one is the sale of peaches and pears each fall. The request is for $8,000 and will be considered during the budget process.
Elfriede Milburn, Caring for Powell’s Animals – RE: Special Funding Request
Ms. Milburn and Ms. Marine presented statistics on dogs and cats brought to the shelter, loss of food donations from Walmart and are requesting the same amount as past years. Commissioner Thiel suggested they check with Downhome Discount as a possible source of food. The request for this year’s special funding is $3,500 and will be considered during the budget process.
Brian Edwards, Park County Engineer, Public Works Department – RE: Recommend Award of Contract for Procurement of Drainage Materials for Willwood Road Phase 1 with Chair to Sign Agreement Pending County Attorney Review
Cody Schatz, Engineering Associates recommended accepting the bid from Ferguson Water Works confirming they are a Wyoming firm and in good standing. They also confirmed they can meet the delivery timeline.
Commissioner Thiel moved to accept Ferguson Water Works of Wyoming for supplies pending attorney approval and allow the chair to sign, Commissioner Livingston seconded, motion carried.
Commissioners – RE: Health Insurance Rates
Clerk Renner stated that the county insurance consultant recommends an increase of 4.3% however the Health and Wellness Committee would like to propose a 2% increase for this upcoming budget cycle. Commissioner Livingston moved to accept health wellness committee recommendations of 2% increase on health insurance rates Commissioner Thiel seconded, motion carried.
Charlie Jones, Mannahouse Food Pantry – RE: Special Funding Request
Mr. Jones gave a brief history of volunteers, donations and donated food, families served, and grant money received. Mannahouse works closely with Cody Cupboard, Loaves and Fishes and the Senior Centers so no food is wasted. The request for this year is $15,000 and will be considered during the budget process.
Commissioner Thiel questioned whether the City of Cody donates with maybe the possibility of donating the utilities.
Jona Harris, Park County Animal Shelter – RE: Special Funding Request
Jona Harris introduced herself as the new executive director and the members of the board who were present.
Ms. Harris stated historically the Board has supported the animal shelter, last year was the first year that did not happen. The shelter cannot succeed without community support. Ms. Harris gave statistics on animals received to the shelter, cleared up the misconception of a “no-kill shelter” with a 95% save rate. The request for this year is $21,000 and will be considered during the budget process.
