Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, May 5, 2020. Present were Vice Chairman, Lee Livingston, Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner.
Commissioner Thiel led the audience in the Pledge of Allegiance.

Approve-Minutes, Payroll and Vouchers
Commissioner Livingston made a motion to approve the following consent agenda items: minutes from April 21 and May 5, bi-weekly payroll in the amount of $387,035.47 and Elected payroll for $90,690.36; vouchers; Resolution 2020-17 regarding the opening of the courthouse to the public on May 1; lease agreement with Basin Authority for July 1, 2020 to June 30, 2021; and approve ad for upcoming board positions, Commissioner Thiel seconded and the motion carried.

Park County Engineer, Brian Edwards – RE: Review and Consider Approving Consultant/Agreement for Engineering and Planning Services for Biking/Walking Paths in the Powell Area as Funded Through the WYDOT Transportation Alternatives Program (TAP).
Mr. Edwards recommends the approval and signage of the contract with Engineering Associates which WYDOT and the county attorney have approved. This project is funded to the end of 2022. Commissioner Thiel made a motion to proceed and accept the planning services, Commissioner Livingston seconded, and after further discussion the motion carried. Commissioner Overfield abstained from voting.
The Commissioners heard testimony from the Special Funding Entities who receive funding from Park County.

Park County Planning & Zoning Director, Joy Hill – RE: Public Hearing: Ledgerwood Bank Stabilization Repair Project - Flood Plain Permit #4-20
Chairman Tilden opened the public hearing.
Ms. Hill presented the application requesting authorization to restore and reconstruct the existing bank of riprap along a 340-foot strip on the South Fork of the Shoshone River. The area is located 19 miles southwest of Cody. Agency notice requirements have been met. River Masters Environmental Consulting is the contractor and will perform the work. The existing material that washed away will be reclaimed and is enough to restore the riprap bank. Chairman Tilden called for public comments, there being none, Commissioner Thiel made a motion to close the public hearing, Commissioner Overfield seconded, and motion carried.
Commissioner Fulkerson made a motion to approve the flood plain permit with staff recommendations, Commissioner Livingston seconded, and motion carried. RESOLUTION 2020-18
Park County Planning & Zoning Director, Joy Hill – RE: Public Hearing: Pleban Flood Plain Permit
Chairman Tilden opened the public hearing.
Ms. Hill stated the applicant is seeking permission to install five fill camping pads and 120-foot underground electrical 15-amp power with four receptacle boxes. The staff report gives the history of Mr. Pleban’s property.
The applicant shall have a building/zoning permit for each teepee structure and notify the Floodplain administrator when the project is complete, providing photographs showing post-construction conditions. A professional electrician shall provide written evidence that utilities will not be inundated by floodwaters. Portable outhouses/toilets or similar facilities used to store or treat domestic wastewater shall not be placed in the floodplain on this property for more than a total of fourteen days in a calendar year. Any additional structures or development in the floodplain shall require a separate permit.
Public comments in writing have been received. After lengthy discussion regarding the conditions, Commissioner Thiel made a motion to close the public hearing, Commissioner Fulkerson seconded, and motion carried.
Comments from the board regarding toilets in the floodplain, Trout Creek Ranches concerns and how this process has taken two years to complete as Mr. Pleban disagreed with the county Development Standards.
Commissioner Thiel made a motion to approve the floodplain permit with the twelve staff conditions, Commissioner Fulkerson seconded, after brief discussions Commissioners Overfield and Livingston voted in opposition, Chairman Tilden voted aye and the motion carried. Resolution 2020-19
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Hertlzer Variance Request
Chairman Tilden opened the public hearing.
Mr. Dillivan presented the requested variance regarding the 39.98-acre parcel belonging to Hertzler Aviation Group LLC and is located 10 miles southwest of Cody on Road 6WX. Notices and agency referrals were met. This variance will allow the applicant to proceed with a simple subdivision application to split the parcel into two similarly sized lots. No public comments were received.
Chairman Tilden called for public comments, there being none Commissioner Livingston made a motion to close the public hearing, Commissioner Fulkerson seconded, and motion carried.

Park County Sheriff, Scott Steward – RE: Approve and Chairman Sign Eleventh Amendment to the Agreement for Inmate Health Care Services at Park County, WY
Sheriff Steward noted the only change is cost which is increasing 5.3% for the same service. After discussion on what the agreement covers, Commissioner Fulkerson made a motion to approve the amendment to the agreement, Commissioner Thiel seconded, and motion carried.
