Regular Meeting
Tuesday, May 20, 2025
Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, May 20, 2025. Present were Vice Chairman Lloyd Thiel, Commissioners Kelly Simone, Scott Steward and Clerk Colleen Renner. Scott Mangold was absent the entire day.
Zac Taylor led the audience in the pledge of allegiance.

Commissioner Steward made a motion to approve the following consent agenda items: minutes of 5/6/25; payroll in the amount of $522,452.17; vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court and Sheriff; NWC Lease Renewal; out of state travel for Events Department; Catering Permit for Mountain Man LLC. Commissioner Thiel seconded, motion carried.

Park County Commissioners – RE: Development, Standards, and Regulations Update
Chairwoman Overfield gave an update on the DSR 1 which will go back to the public and a public hearing will be scheduled. DSR 2 regarding zoning input closes on May 31 and a second map will be provided after consultants have processed all the public comments. The zoning does not affect how your property is taxed. Updates are present on Park County DSR Update - PublicInput.
Russ Dwyer, Cody Conservation District – RE: Special Funding Request
Mr. Dwyer presented their special funding request for $27,000 to be used for partial funding for a full-time conservation technician.
Mr. Dwyer also questioned the special election the district proposed. Chairwoman Overfield will visit with Mr. Odde in Elections.
Mary Louise Wood, University of Wyoming Extension Office – RE: Special Funding Request
Ms. Wood presented their special funding request for $8,000 which equals about $15.50 per 4-H participant.
Rebekah Burns, Powell Economic Partnership – RE: Special Funding Request
Ms. Burns updated the Board on the 2024 and 2025 events and progress that have been made. The request for the upcoming year is $20,000.
Aaron Buck, Yellowstone Regional Airport Director – RE: Funding Request
Submitted
Mr. Buck is making a request for $33,000 for an annual budget commitment to the airport. The airport is planning a development request for an approach and departure study and is asking the County for $15,000 towards the study.
Jenny Cramer, Park County Planning and Zoning – RE: Brence SS-332 Final Plat Review
Ms. Cramer presented the final plat for John Brence requesting approval to create a non-contiguous, two lot simple subdivision comprised of one 11.21-acre lot and one 11.85-acre lot from two 77+/- acre adjacent properties. If approved there will be a 132.21-acre remainder parcel. The zoning is GR-P, notices and agency referrals have been met with no public comments received. Staff recommend approval with the six conditions which were read into the record.
Commissioner Thiel moved to approve Brence SS-332 as presented with conditions, Commissioner Simone seconded motion carried.
RESOLUTION 2025-30
Elfriede Milburn, Powell Animal Shelter – RE: Special Funding Request
Ms. Milburn gave a brief update and is requesting $3,500 which will help cover food costs.
Melissa Hubacher, Meeteetse Visitor Center – RE: Special Funding Request
Discover Meeteetse – Visitor Center –
Ms. Hubacher stated the funds being requested help meet the lease, advertising and grant matches. The request this year is for $10,000.
Jenny Cramer, Park County Planning and Zoning – RE: Public Hearing: Cody Shooting Complex SUP-194 Amendment
Chairwoman Overfield opened the public hearing.
Ms. Cramer presented a request to amend SUP-194 to allow the addition of approximately 11-acre sporting clay course and an approximate 3-acre archery range to the existing facility that is owned by Park County. The property is in GR-35 zoning and located two miles north of Cody. All adjacent land is federal exempt lands, and the outlaw recreational trail system is just west of the property. Legal notices and agency referrals have been met. Four Conditions were read into the record and condition #3 regarding weed & pest was met and can be removed.
Chairwoman Overfield called for public comments, there being none, Commissioner Steward moved to close the public hearing Commissioner Thiel seconded motion carried.
Commissioner Steward moved to approve SUP-194 with striking condition three, Commissioner Thiel seconded, clay shoot question and fall out zone was clarified and motion carried.
RESOLUTION 2025-31
Jenny Cramer, Park County Planning and Zoning – RE: Public Hearing: Brennan Landing Strip SUP-274
Chairwoman Overfield opened the public hearing.
Ms. Cramer presented an application from Dan & Patty Brennan for a landing strip for private airplane landing and a hangar within the property. Legal notices and agency referrals have been met with no public comments being received. Staff recommend approval with seven conditions read into the record.
Chairwoman Overfield called for public comments there being none, Commissioner Thiel moved to close public hearing Commissioner Simone seconded, motion carried.
Commissioner Simone made a motion to approve Brennan SUP-274 with conditions Commissioner Steward seconded motion carried.
RESOLUTION 2025-32
Jenny Cramer, Park County Planning and Zoning – RE: Public Hearing: Cow Creek Estates MS-88 Sketch Plan
Chairwoman Overfield opened the public hearing.
Ms. Cramer presented the minor subdivision application for Tye and Tammi Henderson requesting approval to split the following 5 lots from an existing 309.29-acre parcel creating two 1.59-acre lots, one 1.12-acre lot, one 2.38-acre lot and one 1.86-are lot. With approximately 300.75-acre remainder parcel. The property is in GR-P zoning, 4.2 miles west of Powell, notices and agency referrals have been met. No public comment has been received, and thirteen conditions were read into the record with #3 being stricken.
Chairwoman Overfield called for public comments there being none, Commissioner Simone moved to close the public hearing Commissioner Thiel seconded motion carried.
Commissioner Steward moved to approve Cow Creek MS-88 striking condition number 3 from all other conditions as listed Commissioner Thiel seconded motion carried.
RESOLUTION 2025-33
Jenny Cramer, Park County Planning and Zoning – RE: Public Hearing: Horizon Estates MS-89 Sketch Plan
Chairwoman Overfield opened the public hearing.
Ms. Cramer presented for C & R Cattle Company LLC a minor subdivision application requesting approval of a five-lot subdivision with one 9.04-acre kit, one 7.88-acre lot, one 11.40-acre lot, one 26.39-acre lot and one 28.45-acre lot for residential and agricultural use. The property is in GR-P zoning and located nine miles west of Powell. Notices and agency referrals have been met, one comment was received from the adjacent land owner concerned about no boundary fence. A Subdivision Improvements Agreement will be required. Staff recommended approval with twelve conditions read into the record. Commissioners questioned #4, #11 and road clarification on sketch plan.
Chairwoman Overfield called for public comments there being none, Commissioner Simone moved to close the public hearing Commissioner Steward seconded motion carried.
Commissioner Thiel moved to approve with removing condition #4, Commissioner Steward seconded motion carried.
RESOLUTION 2025-34
Myron Heny and Marynell Oechsner, Powell Valley Recycling – RE: Special Funding Request
Mr. Heny stated the PVR is requesting $9,000. Powell City residents pay $2.00 while 45% of the customers are rural residents using the facility. Mr. Heny also showed samples of the glass crushing that is now offered at the Recycling Center and soon will be sold as landscaping material.
Mary Johnson, Oxbow Center – RE: Special Funding Request
Ms. Johnson is requesting $50,000 to help cover crisis response and emergency mental health services.
Bill Wiltse, Meeteetse Senior Center – RE: Special Funding Request
President Wiltse representing the Senior Center is requesting $25,000 which $15,000 is used as matching funds for grants, $7,000 to help feed seniors when the center is not open and $3,000 for acquiring a vehicle.
Park County Commissioners – RE: Public Hearing: 3J Trucking LLC, Notice of Appeal of Planning and Zoning Directors Decision Regarding the Mining Operation
Chairwoman Overfield opened the public hearing regarding 3J Trucking not obtaining a mining permit.
Tony Martoglio spoke regarding all the steps taken with MSHA and DEQ to excavate a retention pond on a property just west of Cody owned by Jon Sowerwine and in turn crush and sell the by product of the excavation. At the time Martoglio was told no other permits were needed. DEQ requested they get a CD in 3J trucking and a new permit was sent with the remittance of $4,000, the project ran from April to October 2024 with no violations and was not contacted until this year.
Commissioner Thiel believes the problem is the classification of the land with regards to the LUC and PUD. Several questions were asked of the planning department about applying for a mining permit, a special use permit, whether crushing is allowed and material removed, possible removal of the LUC. Ms. Hill stated they could seek a variance which would need to be applied for by the landowner, Mr. Sowerwine, and proceed. Ms. Hill gave an overview of events in the past and what led to needing a SUP.
Chairwoman Overfield called for public comment with regards to crushing going on on the property. Andy Quick commented on the landowner saying one thing and doing another. There being no further comments, Commissioner Thiel moved to close the public hearing, Commissioner Simone seconded, motion carried.
After further discussions on how to move the process forward there needs to be a decision made on the appeal. Commissioner Simone made a motion to deny the appeal from 3J Trucking LLC so that he may proceed with seeking a variance to remove the crushed material, Commissioner Steward seconded. Commissioner Thiel would like to see this approved with conditions and just remove what is out there now and not allow further operations. Commissioner Steward and Simone do not want to set a precedent. Chairwoman Overfield called for the question, the motion carried with Commissioner Thiel opposed, Overfield voted yes. The appeal is denied.
RESOLUTION 2025-35
Park County Commissioners – RE: Decision on Wyoming Riverwalk Investment LLC Floodplain Permit #2-25
Chairwoman Overfield stated this request is for approval for fill placed in the floodplain and construction of a new water collection system/pipeline. The Board was not ready to decide on this matter at a previous meeting as more information was needed to incorporate the existing conditions, Park County Engineer’s conditions and the LOMA report.
Commissioner Steward made a motion to deny the application, Commissioner Thiel second for discussion, stating that the LOMA is needed to make an informed decision and it was not presented by this meeting as requested in the prior meeting of May 6th. Motion carried, the permit is denied.
