Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, March 2, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, and Lloyd Thiel and Clerk Colleen Renner. Commissioner Joe Tilden was absent.
Commissioner Mangold led the audience in the Pledge of Allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Commissioner Thiel made a motion to approve the following consent agenda items: minutes from February 16, bi-weekly payroll in the amount of $588,891.08 which included insurance; vouchers; letter of Support for the Paul Bruhn Historic Revitalization Grant for the Homesteader Museum; approve and sign a resolution concerning Special Prosecution – Bryan Skoric – RESOLUTION #2021-09; approve certificate to release final payment for Park County Coroner’s Building to Filener Construction Inc. – Brian Edwards; approve and allow Chairman to sign amended and restated Joint Powers Agreement of Wyoming Association of Risk Management Property Insurance; and approve and sign Wyoming Department of Administration and Information, GSA, Department of Family Services Lease Agreement; Commissioner Mangold seconded and the motion carried.

Park County Homeland Security Director, Jack Tatum – RE: Park County Homeland Security Presentation
Mr. Tatum presented the history, planning, organizing and what Homeland Security programs are offered as well as the day to day operations.
UW Extension Debbie Kelly and Bobbie Holder – RE: Design Plan for the Urban Orchard Garden at Park County Complex
Ms. Holder presented the scope of the garden space and partnering with Cody Conservation District and the Park County Library. Kindness Project and Story Walk will be two of the programs offered. Also discussed was the seed library, the Story Walk which consists of stencils being place on the sidewalks with physical activities, a pollinator garden has been put in place at the front of the building and all spaces will be wheelchair accessible and open to the public. Ms. Holder stated they have changed the name to Extension Outreach Garden. Moving forward Chairman Livingston directed them to work with Buildings and Grounds.
Park County Planning & Zoning Director, Joy Hill (Public Hearing) – RE: Ruby Ditch Flood Plain Permit 1-121
Ms. Hill presented the application for the Rooted on the River Ranch, LLC. for bank stabilization project which Sage Engineering designed, and Army Corps of Engineers approved. All regulations were met. No comments from the public were received, however written comments from Park County Engineer and Weed & Pest were submitted.
Chairman Livingston called for public comments. Mr. Darrah of Darrah Law Offices representing Powell Ditch company stated the owner is Rocking Bar Ranch LLC as applicant and permittee which needs corrected other than that correction there are no issues. Ms. Hill stated she will make the corrections.
There being no further comments, Commissioner Overfield made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Thiel moved to approve the permit with the correction of Rocking Bar Ranch LLC., Commissioner Mangold seconded, Commissioner Motion carried RESOLUTION 2021-10
Park County Commissioners – RE: Approve Speed Limit Change on County Road 1AB
Engineer Edwards presented an accident and traffic data report from 2017. After discussion on the current limits on the road, Commissioner Thiel moved to accept recommendation of 55 miles an hour, Commissioner Mangold seconded, and motion carried. RESOLUTION 2021-11.
Park County Commissioners – RE: Approve Reward for Information on County Road Sign Damages
Engineer Edwards stated since last spring damaged or stolen road signs has become an issue. The Sheriff’s office may have information but would like to be able to offer an award to identify the perpetrators. Commissioner Overfield made a motion to offer a reward not to exceed $500, Commissioner Thiel seconded, and motion carried
Park County Commissioners – RE: Discussion on Combining the Town of Meeteetse Planning & Zoning Commission with the Meeteetse Local Planning Area Advisory Commission
Mayor Yetter gave the history of the municipal planning and zoning commission and would like to propose that the Meeteetse P&Z be combined as in the past with the County’s Meeteetse Area Planning Committee. There has been trouble maintaining interest in both boards and filling the positions, combining the boards may make both more viable. After further discussion the Commissioners are in favor of moving forward with the concept of 3 members being Town of Meeteetse residents and 3 members being from the Meeteetse area but outside of the town limits. A Memorandum of Understanding and by-laws will be updated before moving forward.
Park County Commissioners – RE: Discussion on Plastic Bag Usage in Park County
Chairman Livingston began by stating there will be no action at this time, but this is an effort to bring the community together to address this major issue. Mr. Palmersheim spoke regarding the wind-blown litter east of the landfill and reminded everyone to recognize there needs to be a multi-level approach. Civic organizations have contacted the landfill to help with clean-up but as a government agency the county cannot make donations to such organizations. Representatives from two area businesses, Mr. Dixon, Store Manager for Walmart and Mr. Doney, Store Director for Albertsons recognize that this is not only a local issue but a nationwide issue. At the current time both entities allow reusable bags, but you are required to bag your own groceries. Discussion on paper bags was brought up but are mostly obsolete and hard to get. Mr. Powell, Bureau of Land Management (BLM) Representative, stated he has been contacted by citizens regarding the litter issues on BLM lands and is here to help figure out how to alleviate some of the problem.
Park County currently budgets roughly $20,000 for littler pickers and are purchasing new litter screens costing about $60,000. Bucky Hall recommends that we get the cities on board. Chairman Livingston thanked everyone for attending.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Ralston Good to Go SUP 212
Mr. Dillivan presented to the board the site plan review from Horrocks Engineers on behalf of property owner #5 Ralston Wyoming Property LLC which is to develop a 3,300 square foot convenience store with five fueling stations on two lots consisting of 1.3 acres. This is defined as a highway commercial business.
All legal notices and agency referrals have been met. WYDOT, Department of Agriculture, DEQ and to Public Works are all requesting documentation commencing construction of after project completion. One public comment has been received.
Chairman Livingston called for public comment. Dave Barrows, property owner to the west, questioned car lights coming into their home and would they be willing to build a fence, what type of lighting will be at the pumps, how large is the sign and will access only be allowed from the main street off Hwy 14A.
Ms. Hill stated the alley is public access, but clientele would probably enter only from Hwy 14A. Mr. Caden, Horrocks Engineering stated the lighting is within the canopies and there will be no additional lighting, the sign will be on the west end of the lot and there is no fencing in the plan but Mr. Caden will explore that. Jerry Thompson, property owner to the east, is excited to have the new service station.
There being no further public comments, Commissioner Overfield made a motion to close the public hearing, Commissioner Mangold seconded, and motion carried.
Commissioner Thiel moved to approve SUP 212 with the removal of condition 2, Commissioner Mangold seconded for discussion. Mr. Caden stated the food plan review packet needs filled out regardless of what type food sales. Motion carried. RESOLUTION 2021-12
Park County Sheriff, Scott Steward – RE: Approve to Replace Park County Sheriff Staff
Sheriff Steward moved two employees from detention to Deputy Sheriffs and is requesting to replace two detention positions and one position in dispatch.
Commissioner Theil moved to approve replacing the vacant positions, Commissioner Overfield seconded, and motion carried.
Park County Landfill Manger, Greg Palmersheim – RE: Approve Replacing Park County Landfill Personnel
Mr. Palmersheim stated they would like to move one employee to a full-time position and replace one part-time gate attendant. Commissioner Overfield moved to approve one part-time position and moving the half-tome employee to full-time, Commissioner Thiel seconded, and motion carried.
Park County Commissioners – RE: Park County Travel Council (PCTC) (1) & Park County Predator Management Advisory Board (PCPMB) (1) Interviews
Commissioners held interviews with the following persons:

Commissioner Theil made a motion to nominate Tyler Stingley to the Park County Predator Management Advisory Council, Commissioner Mangold seconded, and motion carried.
Chairman Livingston and the board all felt that those interviewed for the Park County Travel Council would be wonderful but with everything they are working on accomplishing the board felt that Mr. Parsons would be the best fit during this time with his experience. Commissioner Mangold made a motion to reappoint John Parsons to the travel council, Commissioner Thiel seconded, and motion carried.
Park County Commissioners – RE: Letter of Support on Senator Lummis Grizzly Bear State Management Act of 2021
Commissioner Overfield stated she liked the letter and the history to understand where the board is coming from. Commissioner Thiel made a motion to sign the letter of support to Senator Lummis regarding grizzly bear management, Commissioner Overfield seconded, and motion carried.
