Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, March 16, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Chairman Livingston led the audience in the Pledge of Allegiance.

Commissioner Tilden made a motion to approve the following consent agenda items: minutes from March 2, bi-weekly payroll in the amount of $410,434.52 and Elected payroll of $90,895.94; vouchers; Monthly Earnings & Collections Statements for the Clerk, Clerk of District Court and Sheriff; Lease Agreement for Department of Family Services; Lease Agreement for Legacy; and Mutual Aid Agreement Between Park County, Wyoming and City of Powell, Wyoming. Commissioner Thiel seconded, and motion carried.

Park County Building & Grounds Superintendent, Mike Garza – RE: Open Sealed Bids for Park County Courthouse Carpet Replacement
The Clerk received one bid. Mr. Garza opened the bid from Decorating Ideas in Powell, the complete proposal is for $114,755.40. Mr. Garza will look over the bid which includes material and labor and return with a recommendation.
Park County Buildings & Grounds Superintendent, Mike Garza – RE: Approve Park County Fair Grounds Temp Personnel
Mr. Garza requested to hire an office staffer and one or two additional employees to begin preparing for the fair. Commissioner Tilden made a motion to approve the request, Commissioner Mangold seconded, and motion carried.
Brian Edwards, County Engineer is requesting to advertise for a road and bridge foreman, as the current foreman is retiring effective June 1. After discussion regarding some consolidation and having another position possibly becoming vacant Mr. Edwards suggested advertising throughout a larger area. Commissioner Thiel made a motion to replace the position, Commissioner Tilden seconded, and motion carried.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Triplett Amended Plat of Blk 1, Original Townsite of Ralston (Lots 3, 4, and 5)
Mr. Dillivan presented the amended plat for Kelly J. Triplett; property is located north of US Hwy 14A and on the east side of Clark Avenue in Ralston. This is a partial vacation vacating Lots 3, 4, and 5 replacing with Lots 103 and 105. Commissioner Overfield made a motion to approve the partial vacation and amended plat, Commissioner Thiel seconded, and motion carried. RESOLUTION 2021-13
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Spomer Gravel Pit Special Use Permit - 216
Chairman Livingston opened public hearing. Mr. Dillivan presented the site plan review for continued use of a sand and gravel operation. The current site is 10 acres and the proposed 120-acre site to be mined over time in increments of 5 to 15 acres. Spomer Construction currently leases the land from Lois Hart owner. The site is located along County Road 3 five miles east of the City of Powell. No public comments have been received and agency referrals have been met. The operational hours will be Monday through Saturday, 7 a.m.-7 p.m. One to six employees which are seasonal, a chemical toilet will be on site and domestic water will be provided. Commissioners questioned condition numbers 5, 7 and 16, and does the SUP in place go with land or landowner.
Chairman Livingston called for public comments. Mr. Darrah representing Mr. Spomer gave the board suggested changes. Mr. Darrah stated that most of what is being questioned will be regulated and monitored by the Department of Environmental Quality. Ms. Umphlett stated that some of what is in question are findings of facts and not conditions.
There being no further public comments, Commissioner Tilden made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Thiel made a motion to approve the SUP with corrections of conditions submitted by Mr. Spomer’s council, Commissioner Overfield is concerned and would like the document worked through and brought back, Chairman Livingston stated the motion dies for lack of a second. Commissioner Overfield made a motion to act later today, Commissioner Thiel seconded, and motion carried. The document will be corrected, and Mr. Dillivan will return.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: One Rock Minor Subdivision Final Plat Review - 35
Mr. Dillivan presented the final plat application for Steve and Linda Sweet requesting approval for a four-lot minor subdivision. One 10.0-acre lot, one 4.39-acre lot, one 6.24-acre lot and one 3.26-acre lot. The proposed subdivision is located seven miles west of Powell and 5.4 miles north of Hwy. 14A. Zoning is General Rural Powell and the land us residential and agricultural. No hearing or other notices are required, no public comments have been received.
Commissioner Overfield made a motion to approve One Rick Minor Subdivision with a note placed on the final plat stating, “Water Quality Analysis collected from a neighboring well detected presence of Coliform and detected Nitrogen in excess of the Maximum Contaminant Level.” and condition two, Commissioner Tilden seconded, and motion carried. Park County Building & Grounds Superintendent, Mike Garza – RE: Approve Vendor for Park County Courthouse Carpet Replacement
Mr. Garza visited with Bonnie at Decorating Ideas and Mr. Garza recommended replacement of the carpet in the hallways, area in front of counters, and purchase all the carpet to have on hand in the amount of $79,688.65 leaving a remainder of $35,066.75 to do the office portions.
Commissioner Thiel made a motion to modify the contract and purchase excess carpet and store, Commissioner Mangold seconded, and motion carried.
Park County Commissioners – RE: Park County Museum Board Interviews
Rebekah Childers was interviewed for this board position.
Park County Commissioners – RE: Discussion on HB135 – Hank Coe Leadership Highway
Chairman Livingston gave an update on HB135 and Park County donating towards the purchase of this sign. After discussion Chairman stated we will wait until the bill is final the what funds are available.
Commissioner Overfield made a motion to appoint Rebekah Childers to the Park County Museum Board, Commissioner Tilden seconded, and motion carried.
Executive Session.
Commissioner Thiel made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ix), Commissioner Mangold seconded, and motion carried.
Commissioner Mangold moved to exit from executive session, Commissioner Tilden seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Chairman Livingston requested Mr. Dillivan present the changes that were made in the Spomer gravel SUP 216. Mr. Dillivan stated after working from Mr. Darrah’s and P&Z’s material they made the following changes regarding parking spaces, reworded condition #3 and removed #4, changed to read 15 acres, removed the road maintenance portion and left in chemical toilet.
Commissioner Overfield made a motion to approve Spomer Gravel as updated, Commissioner Thiel seconded, and motion carried. RESOLUTION 2021-15

Commissioner Mangold made a motion to adjourn, Commissioner Tilden seconded, and the motion carried.
