Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, June 7, 2022. Present were Vice Chairman, Scott Mangold, Commissioners Lee Livingston, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Commissioner Mangold led the audience in the Pledge of Allegiance.
Chairwoman Overfield recognized the loss of Park County Youth Services Coordinator Joe Mickelson and extended condolences to his family.
Consent Items: Approve-Minutes, Payroll and Vouchers
Commissioner Thiel made a motion to approve the following consent agenda items, removing annual modification of shared maintenance agreement with US Forest Service for discussion: minutes from May 17; bi-weekly payroll of $633,042.25 and elected payroll of $92,153.69; vouchers; Board appointment ad for Park County Library Board; amended MOU for lease with Legacy Reserves; petitions and inclusions into the Northwest Rural Water District; malt beverage application for Seth Roberts; CRISIS-COAG agreement; and county health officer contract. Commissioner Livingston seconded; motion carried.
With increasing costs, Commissioner Thiel said it would be a perfect time to look over the maintenance agreement with the Forest Service and keep our working relationship with them. With consensus of the Board, Chairwoman Overfield will set up a meeting with the Forest Service.

Joy Hill, Planning & Zoning Director – RE: Public Hearing: Brown Thomas Meadow Ranch FP 2-22
Chairwoman Overfield opened the public hearing.
Ms. Hill presented the application from Bob Redmond, Brown Thomas Meadow, LLC, seeking to provide at-grade stabilization to 1,132 linear feet of riverbank along the eastern bank of the South Fork of the Shoshone River. Some 2,850 cubic yards of bank revetment would be placed on the property in the mapped floodplain. Public notices and agency referrals have been met. No public comments have been received.
Ms. Hill read aloud the ten standards of evaluation and analysis for approval or denial of a permit. Staff recommendations and photos were also provided.
Commissioner Mangold asked about the role played by the Corps of Engineers. Ms. Hill stated we have their approval to proceed. Once the project is completed both the Corps and Planning & Zoning will be notified.
Chairwoman Overfield called for public comments. There being none, Commissioner Tilden moved to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Tilden made a motion to approve with staff recommendations, Commissioner Livingston seconded, motion carried. RESOLUTION 2022-51
Kim Dillivan, Planning & Zoning – RE: Kloricktree SS-288 Final Plat
Mr. Dillivan presented the final plat application for Rick and Klodette Stroh for a subdivision comprised of one 6.88-acre lot from an existing 140-acre parcel for residential use located in GR-P zoning. Neighboring land is mostly residential, residential/vacant, and agricultural. Notices and agency referrals have been met with no public comments received. The plat shall separately state “elevated nitrate and sodium levels” and comply with other standards.
Commissioner Livingston moved to approve with recommended conditions, Commissioner Mangold seconded, motion carried. RESOLUTION 2022-52
Brian Edwards, Engineer, Public Works Department – RE: Open bids for Motor Graders for the Road & Bridge Division of the Public Works Department
With the supply chain issues, Mr. Edwards stated the bid process was completed early, but no decisions will be made until FY22-23 budget is approved. Bids for four new graders were received from:
Honnen Equipment: $1,530,252,88 with trade allowance of $1,145,663.00 for a net bid of $384,589.88. Delivery by 1/15/2023.
Tractor & Equipment Co.: $1,469,085.96 with trade allowance of $1,168,000.00 for a net bid of $301,085.96. Delivery by June 2023.
Mr. Edwards stated all the documents will be reviewed and he’ll return in one month with recommendations.
Tycee Mohler, UW Extension Office Coordinator – RE: Review and Renew MOU
Ms. Mohler stated her gratefulness for the partnership with the county and continuing support. There has been growth over the last couple of years with 4-H membership and office and website visits. Commissioner Thiel questioned the county’s 50% salary match. Commissioner Livingston stated that if the state gives a bump, the county must match the salary bump.
Commissioner Livingston moved to approve and allow the chair to sign, Commissioner Tilden seconded, motion carried.
Executive Session
Commissioner Tilden made a motion to enter executive session pursuant to W.S. § 16-4-405 (a)(ii), Commissioner Thiel seconded, and motion carried.
Executive Session – continued after lunch
Commissioner Livingston moved to exit executive session, Commissioner Tilden seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Kim Dillivan, Planning & Zoning – RE: Jody Lane MS-63 Final Plat/SIA
Mr. Dillivan presented the final plat for applicants Brett & Cathy Whitlock, requesting approval to vacate and re-subdivide Lot 2 of the Miller SS-33 into a four-lot subdivision consisting of two 5.09-acre lots, and two 5.10-acre lots, all for residential use. The applicants also request Board approval of the Subdivision Improvements Agreement (SIA). The property is in GR-5 zoning. Neighboring land is mostly residential with some agricultural to the south and southwest. All conditions are on the final plat and have been met.
Commissioner Livingston moved to approve the SIA as presented, Commissioner Thiel seconded, motion carried.
Commissioner Mangold moved to approve the final plat with recommendations, Commissioner Livingston seconded, motion carried.
Cody Schatz of Engineering Associates described running into issues with SIAs. He asked if the agreements could be looked at before final plat review and turned in with the preliminary plat, as construction cannot begin without the SIA being approved. A discussion was had about the changes in the county over the past two years. RESOLUTION 2022-53

Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a)(ix), Commissioner Thiel seconded, and motion carried.
Commissioner Livingston moved to exit executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Wyoming Rising – RE: Hand Counting Ballots
Renee Tafoya and Phyllis Roseberry are members of the local nonprofit group, which advocates for public education, quality health care, active citizenship, and both have been election judges. Ms. Tafoya stated concerns with the proposal from the Sons of Freedom regarding hand counting ballots, including unnecessary cost to taxpayers, undue privilege to a partisan group, and being contrary to the thousands who believe our elections are secure. Ms. Roseberry covered election law, the oath of all elected officials, attendance at judges’ training and Secretary of State Ed Buchanan’s talks on the security and validity of Wyoming’s elections.
Kim Dillivan, Park County Planning & Zoning – RE: Abraham SS-287 Final Plat
Mr. Dillivan presented for Shelley Williams the final plat for a subdivision comprised of two lots (one 20.0-acre lot, and one 9.69-acre lot) from an existing 29.69-acre parcel for residential use. It’s in GR-P zoning and one mile southwest of Powell. Notices and agency referrals have been met with no public comments received.
Commissioner Livingston moved to approve as presented, Commissioner Thiel seconded, motion carried. RESOLUTION 2022-54

Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a)(ii), Commissioner Tilden seconded, and motion carried.

Commissioner Mangold made a motion to follow through with the action described, Commissioner Livingston seconded, motion carried.
