Tuesday, December 7, 2021
Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, December 7, 2021. Present were Commissioners Scott Mangold and Lloyd Thiel and Clerk Colleen Renner. Vice Chairman, Dossie Overfield and Commissioner Joe Tilden were absent.
Clerk Renner led the audience in the Pledge of Allegiance.

Commissioner Mangold made a motion to approve the following consent agenda items: minutes from November 9 and 16; bi-weekly payroll in the amount of $631,398.71 and $91,535.44 for Elected; vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; USI Agreement; High Country Mercantile Lease Agreement; and Northwest Rural Water Petitions, Commissioner Thiel seconded, and the motion carried.

Planning & Zoning Planner II, Kim Dillivan Re: Public Hearing: Hart Variance Request
Chairman Livingston opened the public hearing.
Mr. Dillivan presented the request from Larry Hart seeking a variance for the consideration of a special use permit that would allow an auto/diesel/farm machinery repair business which would be operated by his nephew. The proposed use is a major commercial business and is not allowed in GR-P zoning. The neighboring land is ag and residential, legal notices, agency referrals and letters to adjacent neighbors were all sent.
Chairman Livingston called for public comments, Scott Lewis with Granite Engineering, Scott Kolpitcke Attorney for the Harts commented. Floyd Derry and Keith Murry showed support for the usage, Donna & Randy Cook, Cook Corporation are opposed and expressed their concerns.
After brief discussions regarding EPA & OSHA regulations, trenching in the building and materials being disposed of properly and the possibility of the property becoming a salvage yard. After final comments, Commissioner Thiel made a motion to close the public hearing, Commissioner Mangold seconded, and motion carried.
Commissioner Thiel moved to approve the variance request, Commissioner Mangold seconded, all in favor and motion carried. RESOLUTION 2021-79
Buck Creek Estates Subdivision, Park County Commissioners Re: Discussion regarding additional requirements related to adequacy of domestic water
Chairman Livingston gave a history of how the board came to this point.
Ms. Hill, Director Planning & Zoning stated the county has hired Mr. Tom Pilch to help with the water study that was presented by Buck Creek Estates. Ms. Hill stated there are statutes that drive a subdivision that must be followed §18-5-306 (a) (xi) and went on to discuss with the Board how to determine adequate water, availability and potability, use of cisterns, individual wells, and sewage systems.
Mr. Pilch recommends a well be drilled in the eastern corner of the proposed subdivision to address water usage, balance time to recharge and determine quantity etc. Commissioner Mangold made a motion to approve recommendations from Pilch and to return to the Board with results, Commissioner Thiel seconded, all in favor and motion carried.
Planning & Zoning Planner II, Kim Dillivan RE: Public Hearing: Inductance Energy Corporation – Zoning Map Amendment
Chairman Livingston opened the public hearing.
Chairman Livingston reported the applicant has withdrawn its Zoning Map Amendment Application dated July 2, 2021. At this time, IE is not prepared to move ahead with this application as stated in a letter dated to December 2, 2021, signed by Richard Hawley, VP of Business Development.
Commissioner Mangold made a motion to close the public hearing, Commissioner Thiel seconded, all in favor, motion carried.
Kathy Liscum, Cody Pardners Re: conditional approval of lease for Bistro space at Library
Ms. Liscum brought forth a couple revisions that did not apply to Cody Pardners and their plan for the Bistro. Clarification on maintenance, replacement or repairs on equipment required to run the café was requested. This agreement is for one year. At this time the freezer is not in working condition and Mr. Garza is looking into repair or replacement.
Commissioner Thiel made a motion to move forward with the lease agreement contingent on County Attorney approval, Commissioner Mangold seconded, all in favor, motion carried.
Park County Public Works, Brian Edwards Re: Review bids for heavy equipment (dump truck & two excavators) for Road & Bridge and Landfill Divisions
Mr. Edwards opened three sealed bids for the dump truck and two excavators that were received on time in the Clerk’s office.
Honnen Equipment – John Deere, gave bids for a small ($209,252.09) and large ($218,339.29) excavators with buy back and trade in options quoted. Depending on which option is selected a delivery date of 180 days or earlier is possible.
T & E Equipment – Caterpillar, gave bids for a small ($217,809.83) and large ($244,156.13) excavators with buy back and trade in options quoted. Depending on which option is selected a delivery date of April 18, 2022 could be possible.
Tristate Equipment – Volvo, gave bids for a small ($189,664.00) and large ($207,271.00) excavators with buy back and trade in options quoted. Depending on which option is selected a delivery date August 1, 2022 could be possible.
Bids for the articulating dump truck were opened next.
Honnen Equipment – John Deere - $484,317.97, did not list buy back, not applicable and no guarantee on delivery date was stated.
T & E Equipment – Caterpillar - $452,416.52, listed buy back and a delivery date of the week of June 13, 2022.
Tristate Equipment – Volvo - $473,500, listed buy back and a delivery date of the week of August 1, 2022.
Mr. Edwards would like time to review the bids and return on either December 14 or 21 with recommendations.
