Chairman Fulkerson called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, August 20, 2019. Present were Commissioners Lee Livingston, Dossie Overfield and Lloyd Thiel, and Clerk Colleen Renner, Vice Chairman, Joe Tilden was absent.
Michael Conners led the audience in the Pledge of Allegiance.

Approve-Minutes, Payroll and Vouchers
Commissioner Thiel made a motion to approve the following consent agenda items: minutes from August 6 and 13, bi-weekly payroll in the amount of $456,723.42, vouchers, monthly earnings and collection statements from the Clerk, Clerk of the District Court and Park County Sheriff, approve the RFP for Park County Land Use Plan, contract between Wyoming Department of Family Services and Park County Commissioners – TANF Funding in the amount of $63,000 and Northwest Family Planning Rental Space Agreement at the Powell County Complex. Commissioner Livingston seconded and the motion carried.

Park County Chief IT Officer, Michael Connors – RE: Approve and Chairman Sign New Resolution Imposing 911 Emergency Telephone Tax Increase of $.50 to $.75 for Service Users in Park County
Mr. Conners brought forth the Resolution that formalizes what was approved after the Public Hearing on the August 6th County Commissioner meeting, Commissioner Livingston made a motion to sign the resolution, Commissioner Overfield seconded, and motion carried. RESOLUTION 2019-48
Park County Director of Homeland Security, Jack Tatum – RE: Approve Items Purchased for State Homeland Security Grant Program
Mr. Tatum presented a list of items he would like to purchase for the Homeland Security program. Several of the items could be purchased with next year’s grant instead of immediately. Commissioner Livingston made a motion to allow Mr. Tatum to purchase those items that are not grant eligible and to postpone purchasing those that we can be purchased through the grant, Commissioner Overfield seconded, and motion carried.
Liaison Reports
Commissioner Thiel reported on Weed & Pest, Meeteetse Local Planning, Predatory Board and Powell Urban Systems.
Commissioner Livingston reported on the Fair Board, the Game & Fish property which will be relocating, Forest Service and the Governors Match held at the Cody Shooting Complex.
Commissioner Overfield reported on the public meeting with Bureau of Land Management, Parks & Rec, Cody Urban Systems and Cody area survey, Budget committee and assisting with Forward Cody audit in September.
Chairman Fulkerson reported on Library Board, Wyoming County Commissioners Association, Brian Edwards with Call Before You Dig, Wyoming’s lead in inaccessible public lands, and the Short-Term Rentals public meetings.
Park County Planning & Zoning Planner II – Kim Dillivan – Public Hearing – RE: Wyoming High Desert Malt – SUP 186
Chairman Fulkerson opened the public hearing.
Mr. Dillivan presented the staff report requesting approval for a value-added agriculture business at 1114 Emery Road, Powell. The project site is south of County Road Lane 11 and northwest of Ralston in a GR-P zoning district. Neighboring land uses are agricultural. Legal notices have been met and the application was forwarded to agencies as required. No public comments were received.
Chairman Fulkerson called for public comments, there being none Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Thiel made a motion to approve the special use permit, Commissioner Livingston seconded, and motion carried. RESOLUTION 2019-49
Park County Planning & Zoning Planner II – Kim Dillivan – Public Hearing – RE: AmSum Enterprises Water Bottling SUP-181
Chairman Fulkerson opened the public hearing.
Mr. Dillivan presented the staff report requesting approval for a Major Industrial Use in a GR-35 zoning district to re-establish a water bottling facility using the natural artesian spring water located on the property. The facility is located 10.7 miles west of UW Hwy 120 along County Road 8VC. The Board approved a variance (Resolution 2019-21) classifying this for major industrial use. Legal notices have been met and the application was forwarded to agencies as required. Verbal and written comments were received from the public who were concerned about the variance for this use, but none regarding SUP request. There is no permit on file for the septic system and no evidence is existing which will need to be proven or a new system installed.
Chairman Fulkerson called for public comment. Bob Savala made comments regarding septic, the disrepair of the property and broken windows. Scott Northrup, applicant, stated maintenance has been deferred by the current owner and then questioned why the number of employees he plans to hire would be limited. Forward Cody Executive Director James Klessens discussed the concerns regarding the septic system.
There being no further comments Commissioner Thiel made a motion to close the public hearing, Commissioner Livingston seconded, and motion carried.
Commissioner Thiel made a motion to approve the SUP with only condition #4 regarding noxious weed control. Commissioner Livingston seconded for discussion. After further discussion Chairman Fulkerson called for the question, Commissioner Thiel voted aye, Commissioner Overfield and Livingston voted nay, motion failed. After further discussions with regards to county regulations, home versus business use Commissioner Livingston made a motion to approve the SUP with conditions #1 and #4 to be completed prior to operation, Commissioner Overfield seconded, and motion carried. Park County Planning & Zoning Director, Joy Hill – Public Hearing –RE: Ira Fellows Road Repair Flood Plain Permit 5-19
Ms. Hill presented the staff report for the Ira Fellows road repair which is in the flood plain. The zoning is general rural Meeteetse, the purpose is to repair/replace 150 ft section of bank along Dick Creek where the stream has washed out a portion of the road. Public Works and Army Corps of Engineers have been involved.
Chairman Fulkerson called for public comments, there being none Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Livingston made a motion to approve the flood plain permit, Commissioner Thiel seconded, and motion carried. RESOUTION 2019-51
PEP Executive Director, Christine Bekes and Wyoming Broadband Manager, Russ Elliott – RE: Innovative Mapping Tool Quantifies Wyoming’s Broadband Needs
Ms. Bekes introduced Russ Elliott who presented an update on broadband coverage in rural areas using an interactive map that shows results of internet speed tests and broadband availability across Wyoming. The next step is to get residents to continue to take the speed test on their home computers or mobile devices by going to this link http://wyomingbusiness.org/broadband. This detail is very important in rural Wyoming to help increase the availability in the future.
Park County Museum Board President, Terry Hinkle – RE: Replacing a Park County Museum Employee
After short discussion regarding the part time curator assistant and their duties, Commissioner Livingston made a motion to grant permission to replace the part time curator assistant, Commissioner Overfield seconded, and motion carried.
Mr. Hinkle explained to the commissioners that a part time museum employee needs additional donated sick time. Clerk Renner stated the policy manual allows for a department to request additional donated sick time for an employee who has used all they have accrued. Mr. Hinkle is requesting the commissioners approve an additional 40 hours of sick time. Commissioner Livingston made a motion to approve the additional sick hours, Commissioner Thiel seconded, and motion carried.
Executive Session.
Chairman Fulkerson convened an executive session pursuant to W.S. § 16-4-405 (a) (ix).
Commissioner Overfield moved to exit from executive session, Commissioner Thiel seconded, and the motion carried.
Commissioner Livingston made a motion to retain services from Amanda Roberts an attorney with Lonabaugh & Riggs, LLP, Sheridan Wyoming to represent Park County due to a conflict of interest as declared by the County Attorney’s office, Commissioner Overfield seconded, and motion carried.
Yellowstone National Park Superintendent Cam Sholly – RE: Visit with the Park County Commissioners
Mr. Sholly gave an update on the strategic plan, visitor use and expectations, increased visitation, the gateways to the park and their needs. Mr. Sholly also discussed the importance of bringing broadband technology to the park for not only public safety but for year-round employees too. Mr. Sholly also gave an update on the Fishing Bridge construction project that should be completed in 2020.
