Tuesday, November 19, 2019
Chairman Fulkerson called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, November 19, 2019. Present were Vice Chairman, Joe Tilden, Commissioners Lee Livingston, Dossie Overfield and Lloyd Thiel, and Clerk Colleen Renner.
Lindy Lynn led the audience in the Pledge of Allegiance.
Ms. Lynn, field representative for Congresswoman Liz Cheney, was in the area and stopped in to see if the Commissioners had any issues, they would like her to convey to Representative Cheney. Commissioner Tilden asked when the WPLI issue will be resolved, Ms. Lynn stated this is not a forgotten matter however it has not gained traction to move forward at this time. Commissioner Theil would like to see legislation addressing the country of origin labeling with regards to meat packers. Chairman Fulkerson thanked her for coming and the opportunity to comment.

Park County Engineer, Brian Edwards and Park County Project Manager, Ben McDonald - RE: Opening Bids for Dust Suppressant Application Pertaining to Certain County Roads – CMAQ FY 2019-20
Two bids were received by the County Clerk’s office. Mr. McDonald stated the bids are for seventeen miles of dust suppressant in the Cody, Powell and Meeteetse areas. Desert Mountain Corp, Riverton bid $111,302.40 and Dust Buster Inc., Evanston bid $97,102.81. This project is an 80-20 split with WYDOT, and the county share has been budgeted. Mr. Edwards and Mr. McDonald will return later with their recommendation.
Liaison Reports – Commissioner Tilden excused himself at this time.
Commissioner Thiel reported on Meeteetse Local Planning Area which has not met, Park County Predatory Board is seeing an increase in domestic dogs becoming predators, Meeteetse Visitor Center and Urban Systems of Powell have not held a meeting recently. Commissioner Thiel attended the Beartooth Ranch walk through with Game & Fish as a member of the public and not representing the Commissioners.
Commissioner Livingston reported on Yellowstone Eco Systems subcommittee meeting regarding grizzly bear awareness, conflict situations, field encounters and updates on how to react were discussion points during a round table meeting October 30 and 31. Park County Fair Board will be holding a meeting November 21 at the Grizzly Room in the Park County Library to hear input, concerns and take questions regarding the most recent fair.
Commissioner Overfield reported on Museum Board, Library Board and the manager position that needs refilled, Cody Urban Systems regarding a potential crosswalk on Big Horn and Freedom Street, Park County Rec Board and situation with State Department of Audit regarding Form F-32 which they should not be required to complete as they receive no outside funding. Funds have been granted to the Powell Golf Course to purchase new carts.
Chairman Fulkerson reported on Forward Cody, the WCCA audit committee and reminded everyone that Park County will host the four county Legislative Meeting here in January and meet in February with Legislators in Cheyenne.
Commissioner Thiel gave one more report on his attendance at the Ranch
Seminar in Meeteetse put on by the Conservation District.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Kallem Minor Subdivision - 32 Sketch Plan Review
Chairman Fulkerson opened the public hearing.
Mr. Dillivan presented the sketch plan to create a four-lot minor subdivision located 5.8 miles east of Powell on Lane 9. The parcel is located within GR-P zoning district. Notices and agency referrals were completed. All easements as requested by applicable utilities, special and irrigation districts or public agencies providing services must be identified on the final plat. The right-of-way for Road 2 must be shown on the plat, approved long-term noxious weed control plan must be submitted prior to final plat review and applicant shall otherwise comply with county standards.
Chairman Fulkerson called for public comment, there being none Commissioner Livingston made a motion to close the public hearing, Commissioner Overfield seconded, and motion carried.
Commissioner Overfield made a motion to approve the sketch plan as presented with conditions recommended by staff, Commissioner Thiel seconded, motion carried. RESOLUTION 2019-61
Park County Library Director, Frances Clymer – RE: Approval to Replace Cody Library Manager
Ms. Clymer is seeking permission to advertise and hire a Library Manager with the forthcoming retirement of Marjorie Buchholz after 41 years of service. After discussion Commissioner Thiel made a motion to allow the library to replace the manager position, Commissioner Livingston seconded, motion carried.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Clark Simple Subdivision – 85 Partial Vacation and 2nd Amended Plat
Chairman Fulkerson opened the public hearing.
Mr. Dillivan presented the second amended plat of Clark Simple Subdivision-85. The subdivision is located just east of Road 11 and north of Lane 6. Notices were met and the Plat Review Committee approved. This process does require new deeds to be filed that will change ownership and legal descriptions.
Chairman Fulkerson called for public comment, there being none Commissioner Livingston made a motion to close the public hearing, Commissioner Overfield seconded, and motion carried.
Commissioner Thiel made a motion to approve Clark Simple Subdivision-85 Partial Vacation and 2nd Amended Plat, Commissioner Livingston seconded, motion carried. RESOLUTION 2019-62
Park County Public Health Nursing Manager, Bill Crampton – RE: Approval for Park County Public Health Temporary Employee –
Commissioner Thiel abstained and left the meeting.
Mr. Crampton would like to add a temporary employee to fill in for staff when they request vacation or are sick. This allows the offices to remain open to the public. After discussion Commission Livingston made a motion to fill the temporary position, Commissioner Overfield seconded, motion carried.
Commissioner Thiel returned to the meeting.
Park County Engineer, Brian Edwards and Park County Project Manager, Ben McDonald – RE: Review and Consider Staff Recommendations for Award of Contract for Dust Suppressant Application Pertaining to Certain County Roads – CMAQ FY 2019-20
Mr. Edwards returned with the recommendation to award the bid to Dust Buster Inc., in the amount of $97,102.81. Commissioner Livingston made a motion to approve the award based on Mr. Edwards’ recommendation and WYDOT’s concurrence, Commissioner Thiel seconded, motion carried.
Commissioner Tilden returned at this time.
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (iii), Commissioner Overfield seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Tilden seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Park County Planning & Zoning Director, Joy Hill – RE: Public Hearing: TE Ranch Limited Partnership Small Wastewater System Construction Project Floodplain Development Permit #6-19
Chairman Fulkerson opened the public hearing.
Ms. Hill presented to the Board an application to replace two individual septic systems that are currently discharging in the floodplain with a combined septic system that pumps effluent to a new leach field above the floodplain. The existing septic has been in place for many decades. Notices and agency referrals were completed. James Brough, Northwest District Engineer, Water Quality Division concurred with the submitted design. Staff recommends approval with the following conditions: the permit is valid for one year, applies to components under Septic System Permit #20191105-2, the County Small Wastewater Administrator shall conduct an inspection prior to backfilling any components and the County Floodplain Administrator must be notified when the project is complete.
Chairman Fulkerson called for public comment, there being none Commissioner Overfield made a motion to close the public hearing, Commissioner Livingston seconded, and motion carried.
Commissioner Livingston made a motion to approve with conditions, Commissioner Tilden seconded, motion carried. RESOLUTION 2019-63.
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ii), Commissioner Tilden seconded, and motion carried.
Commissioner Overfield moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. Commissioner Overfield made a motion to opt out of the National Prescription Opiate Litigation, Commissioner Tilden seconded, motion carried.
