A Powell man stands accused of having threatened another man with a rifle after becoming upset with his driving on Saturday afternoon.

Alex Timmons, 25, is charged with a felony count of aggravated assault for having allegedly threatened to use a drawn deadly weapon. Timmons remained jailed in the Park County Detention Center on Wednesday, with bail set at $7,500.

When questioned by Powell police on Saturday, Timmons acknowledged trying to confront the other man about his driving, but denied ever using a gun, charging documents say.

The other man told Powell police the incident started while he was driving his vehicle through puddles on Division Street. Around Avenue H, he passed a green pickup truck with two men inside.

The young man told police “there was a lot of water on Division Street and it was possible he had splashed water on his (Timmons’) truck,” Officer Jason Pellegrino recounted in an affidavit filed in support of the criminal charge.

The young man said the green truck immediately began following him through town, and he couldn’t lose it. When the vehicles reached Panther Boulevard and Monroe Street — near the Powell school district’s bus barn — Timmons got out of the truck with a rifle in his hands, the young man told police.

The young man sped away, telling Pellegrino that, in his rear view mirror, he saw Timmons pointing the gun in his direction.

Pellegrino later stopped the GMC Sonoma carrying Timmons and another man near the Family Dollar store. Pellegrino and Officer Danny Hite approached the vehicle with their guns drawn (though lowered) and directed the occupants out of the GMC, Pellegrino wrote.

Police found a loaded 8mm Mauser, bolt-action rifle between the driver and passenger seats.

Timmons told Pellegrino he had followed a young man who’d nearly hit his truck and splashed him with water.

Timmons said he got out of his truck and tried to confront the young man about his driving near the bus barn, but said the rifle had stayed in the truck, Pellegrino wrote.

Timmons later added that if the young man had gotten close, “I would have got it (the gun) out and I probably would have shot at him,” Pellegrino recounted.

Asked to explain that logic, Timmons said he’d have no problem shooting at someone if he felt threatened, Pellegrino wrote.

When Timmons was administered a breath test after his 3 p.m. arrest, his blood alcohol content was pegged at .237 percent, charging documents say. The legal limit in Wyoming is .08 percent.

The young man and Timmons each told police they didn’t know each other before the altercation.

A preliminary hearing, where a judge will determine if there’s enough evidence for the aggravated assault charge to proceed toward a trial, is tentatively scheduled for June 4.
